ABSTRACT

Artificial Intelligence is currently transforming many domains of the global society with significant concerns to the field of international law. This research paper examines the relationship that the emerging technology, AI has with international laws and policy. It explores its opportunities and threats to effecting a change in conventional legal paradigms that it offers. We are therefore inclined to focus on the extent to which it is possible to extend the meaning of the international regulations to accommodate the implications of AI technologies, the ethical issues of the application of artificial intelligence and the interplay between sovereignty and human rights. This paper will extract existing literature sourced on periodicals, books, and reports to explain how the international law is adapting to AI’s presence.

Finally, it provides an analysis of major shortcomings in existing legal instruments and gives suggestions to discover and establish effective international norms regarding the new technological threats. Finally, the paper advocates for active inclusion of the AI concerns into the international legal frameworks so that there is a harmonization between adoption of the new technologies and legal responses.

INTRODUCTION

Artificial intelligence or AI is a revolutionary technology that is revolutionizing several aspects of the contemporary world and indeed it is not an exception in the case of international law. This technological revolution, which has recently emerged in the development of machine learning, data analysis and autonomous systems presents legal challenges and opportunities for legal systems that were previously designed to regulate and govern human, civil and state society. Recapping the AI’s introduction into international law, it is easy to note that the intersection of technology and governance is one of the core areas of legal development, and the current legal systems can be challenged to address the new phenomena and evolve to regulate the progress.

The rules of international law based on state sovereignty, human rights and cooperation on the international level are playing into more challenges as AI technologies are progressing. Current legal frameworks are the principles that have regulated the relationship between states through former legal sessions including territorial disputes trade and human rights among others are now being stretched by the current development of Artificial intelligence. For example, AI can be used to improve decision-making and productivity in various industries, on the other hand, it presents questions about data protection and security alongside abuse of the technology. Due to the advancement of the functionalities of AI, there arises questions as to the legal aspect of state sovereignty and international relations.

However, the application of AI also has a positive impact where it can change and improve the legal practices with both opportunity and threats. On the one hand, AI can bring a number of benefits for legal workers and the legal system as a whole, for example, automation and enhancement of some case handling and research processes. On the opposite, they pose new ethical and regulatory quandaries such as issues of bias and/or accountability as well as issues of transparency. The importance of AI on human rights and ethical requirements also continues to rise as systems developed become more complex. The change of paradigm that brought AI into the practice of law means the need to reconsider the legal norms prescribing its activity and create new frameworks that can adequately meet the challenges the new tools pose to international law.

Therefore, the purpose of this paper is to discuss current international law applicable to AI, analyze legal loopholes and offer recommendations that will ensure the formulation of sound international laws, which will enable international effective regulation of AI. In this manner, this work aims at advancing the understanding of the application of AI alongside international law in order to better capture the continually shifting dynamics of the international legal regime.

LITERATURE REVIEW

A vast literature is available concerning the topic which deals with Artificial Intelligence and International Law to understand how these technologies are reshaping the legal context. An important read in this field is ‘Artificial intelligence and International law’ by J Lee published in 2022. 1This book discusses how AI influences the theoretical framework of the international legal norms and gives practicality on how the advancement of technologies impacts the legal framework. He successfully discussed the conflict between technological progress and the slow evolution of the systems of international law that regulate it, making the work valuable for understanding the general impact of AI on the organization of world relations. One of the papers, which have largely explored how AI affects legal doctrines, is Surden’s “Law and Artificial Intelligence” (2020).

2 From Surden’s perspective, current laws are insufficient to deal with the emerging challenges that relate to AI and therefore urges for amendments that will check for the appropriate usage of AI. When it comes to values and specifically ethical aspects of AI it can be said that this work is highly valuable due to its deterministic role in defining the legal guidelines of AI. AL Schuller’s edited volume,3 explores how AI is redefining international legal practices. This set of articles gives multiple visions concerning the impact of AI on international law analyzing its impact on state jurisdiction, human rights, and international legal cooperation. This volume underlines the requirement for new legal standards and presents a variety of perspectives on how to overcome the threats AI created.

The UN’s report, "Regulating Artificial Intelligence: Global perception on different States’ regulations and effects on the international legal frameworks were discussed in the paper “Approach to global regulations around AI (2023)”.5 Taken together, these sources demonstrate that there is a lack of a comprehensive legal approach to AI: where existing frameworks fall short of providing requisite defenses, and which provide the necessary background knowledge for subsequent studies in the field and improvements in policy.

METHODOLOGY

The fundamental approach used in this research paper is qualitative research in order to examine the relationship between AI and international law. The approach essentially involves a literature review of books, journal articles and institutional papers to understand how AI is impacting legal systems, and what adjustments may be required. The advantage of this research is that it is qualitative, and thus enables the analysis of theoretical and practical implications of AI in international law. In supplement to the literature analysis, the present study uses comparative analysis to analyze how different international legal systems respond to challenges relating to AI. This entails analyzing legal practices in various jurisdictions to determine similarities, differences, and even shortcomings in the existing frameworks.

The comparative analysis thus helps to understand how various countries and international organizations approach AI issues and what measures can be taken to develop a coherent system of international regulation. Case studies are also utilized to illustrate practical examples of AI interacting with international legal frameworks. These case studies suggest applied settings where AI technologies have made a difference in legal proceedings or in regulation, thus illustrating the possibilities and weaknesses of fair current paradigms in law. CRITICAL

ANALYSIS

Artificial Intelligence (AI) in international law poses a set of instrumentalities and prospects that range from critical in the traditional legal regulatory mechanism systems. Among these issues the first one is the ability of present-day legal standards to effectively regulate the challenges posed by AI technologies. The traditional international law has been focusing on matters like sovereignty of states, rights of individuals and interstate relations, which are relatively getting blurred because of faster developments in the field of AI. Current paradigms do not provide adequate guidance on issues like data protection, responsibility, and the proper utilization of AI, resulting in major governance blind spots. 6 The ability of AI in ingestion of large quantities of information increases concern of the protection of data.

The legal frameworks governing various activities especially in the field of technologies were not created or developed for the use of AI and these gaps are not provided for by the traditional basic concepts of the legal systems of the countries. For instance, GDPR is a well drafted legal mechanism for data protection but the use of AI in technologies like automated decision-making, and profiling, is a questionable area. That is why there is a need to have laws that can be precise on the issues raised by the AI while at the same time protecting privacy rights but at the same time allowing for technological development7. Another problem is again the ability of the AI systems to retain and possibly intensify the existing biases. Deep learning is biased if the training dataset the company feeds to the algorithms are biased in the same way as the society.

This then causes some ethical and legal questions related to fairness and discrimination to be raised. This means that there is a requirement for updating the international legal frameworks so as to make them provide controls that would prevent or regulate the ATI from being developed and deployed in a manner 6 Hárs, András. "AI and international law–Legal personality and avenues for regulation. " Hungarian Journal of Legal Studies (2022). 7 Rayhan, Rajan, and Shahana Rayhan. "AI and human rights: balancing innovation and privacy in the digital age. " DOI: 10. 13140/RG. 2. 2 35394 (2023). that causes violation of human rights or compounds the already existing inequalities. 8 In addition, there is an issue of liability regarding the decisions made through the use of AI technologies.

Identifying instance responsibility when errors occur or the AI program brings negative impacts can be challenging since it involves identifying roles of creators, managers and end-users. Laws as of now may not be able to address these issues effectively hence calling for a new approach regarding accountability and liability of AI.

COMPARATIVE

ANALYSIS

An evaluation of how countries and international organizations have characterized and responded to Advanced Artificial Intelligence (AI) shows that there is a variation in how responses are made. The comparative analysis of the existing approaches allows us to define the similarities and differences, and the emergence of gaps in these approaches, which gives an idea of the possible directions for the further development of comprehensive global standards. 9 Thus, the European Union has quite a well-developed stance concerning the regulation of Artificial Intelligence. The European Union’s Artificial Intelligence Act that was proposed intends to provide legal measures that classify AI systems according to hazardous levels and accost high-risk prospects.

It is such an approach that may be considered as responsive to AI prospective impacts within not only ethical and legal but also social contexts, where the emphasis is made on fairness, openness, and non-jeopardy. The EU approach of risk-based regulation is being used as an example that other jurisdictions may consider following. 10 On the other hand, The United States has been relatively liberal in the regulation of AI, and the controls set are not very centralized. There is paramount concern toward AI policy; however, the regulatory measures are highly diversified across both the federal and the state levels, and the complete absence of a national strategic plan. In its turn, the American approach focuses more on the concept of innovation for the economic growth of the country and, at times, gives preference to the very concept over strict measures of legislation.

Such an approach is likely to

China’s, on the other hand, are distinguished for their focus on state regulation and AI’s integration into the national development plans. China has adopted favorable policies towards the development of AI technology but at the same time the government has laid down some tough legal provisions about data protection and cyber security.

But this is quite far from what is happening in the Western countries where even global organizations play into the hands of people’s opulence and protection of freedom of choice made by individuals in different domains of their life process. 11 The comparison of the legislation reveals the necessity for the concerted efforts at the international level in creation of harmonized and efficient regulations concerning AI. These differences in regulatory approaches clearly indicate the tasks inherent in the endeavor of developing transnational standards bearing in mind the complexity of legal systems as well as cultural frameworks.

In order to overcome these issues, the representatives of the worldwide organizations and the participants of the distinct jurisdictions should join the efforts in legal unification and elaboration of the principles that will allow combining the innovative initiatives with the moral requirements and the protection of human rights.

CONCLUSION

AND SUGGESTION Integration of AI and international law can be beneficial to a significant extent, however it also poses viable threats. With the advancement of AI technologies and applications, the existing legal systems are put to the challenge by problems that come with such technologies including data privacy and accountability as well as ethical use. The modern international legal regime is insufficient to solve similar issues, which indicates the need to establish the principles of effective governance and protection of the mentioned fundamental rights. In pitching the legal norms, we can observe that AI subversion is revolutionizing the observation and considerably altering the implementation as well as interpretations of the law. First, AI often challenges standard international laws and regulations, many of which were not developed with contemporary technology in mind.

This lack of regulation has therefore

necessitated the development of a new legal regulation regime that will be able to address the various issues that have been brought about by the integration of AI while at the same time promoting the uptake of technology. Thus, the critical analysis has focused on such problems as data protection violations and bigoted tendencies of AI that remain as evidence of the demand for diverse and complex legal actions. In response to these challenges the following recommendations are proposed. First of all, it is hence necessary to outline extensive international regulations. These regulations should hence center on revealing acceptable benchmarks into the preservation of data in use by the artificial intelligence systems, the degree of responsibility expected of the developers of these systems, and the level of transparency that should be available to the general public.

One solution to this problem is the internationalization of AI regulation, meaning that the development of rules for the limitation of artificial intelligence will be unified and coherent throughout the world. Such organizations as the United Nations and the International Telecommunication Union have the potential of leading such campaigns. 12 Second, establishing international cooperation is effective to create coherent legislation. The comparison and contrast reveal that there are many similarities in the regulation of AI across the analyzed jurisdictions but also many differences. In these regards, different countries require coming up with standard measures and appropriate benchmarks. This would assist in combating cross-border offenses and ensure that the legal solutions provided for such problems do not only work but are fair as well.

13 Third, it is essential to improve legal education and research on AI as legal professionals are to adapt to emerging changes in the realm of international law. With regards to the change that incorporates an ever-rising emphasis on AI in legal education can assist future legal workers acquire an understanding of the novel intricacies brought about by developing technologies. Fundamental research proposals must seek to uncover new legal theories that are more capable in addressing AI peculiarities. 14 12 Aygun, Mesut. Finally, there is the need to involve the stakeholders in technologies that include developers, policy-makers, and civil society that will help in determining cohesive regulations. The use of stakeholder engagement makes it easier to determine the practical issues present and the best solutions possible while dealing with some of the issues to incorporate a new idea or change an existing system.
