LEADING INTERNATIONAL ENVIRONMENTAL

PROTECTION CONVENTIONS: AN INTERNATIONAL ACCEPTANCE

Ravi Prashant, Amity Law School, Noida, Uttar Pradesh

ABSTRACT

In this way, the continuation of international environmental protection treaties that build bases of international cooperation are crucial in handling the world’s environmental issues. This paper also discusses the following environmental conventions and their aims: climate change, biological diversity, environmental pollution, and sustainable development. Some of these are the Convention on Biological Diversity (CBD), the Paris Agreement and United Nations Framework Convention on Climate Change (UNFCCC). It was established in 1992 and it sets the stage for climate change negotiations; it assembles countries to address impacts of emission of greenhouse gases. One of the substantive actions was taken in 2015 when the UNFCCC made Paris Agreement that set a limit of the average increase in the temperature at well below 2 °C above pre- industrial levels while pursuing the limit at 1.

5 °C above the same level. In the same regard, the CBD, which was signed in 1992 aimed at ensuring that the utilization of the natural resource was sustainable as well as the conservation of the biological diversity. Due to the concern of crossovers with countries across the globe, international cooperation as captured by these treaties becomes essential in the management of the environment. They know fully well that since this involves conservation of the environment which has implication on livelihoods, people’s health and future generation it is not only an ecological issue but an economical one as well. Keywords: International environmental protection treaties, Convention on Biological Diversity (CBD), Paris Agreement, United Nations Framework Convention on Climate Change (UNFCCC)

Introduction

In this regard, international environmental treaties are important since they help in promoting international cooperation and set up a structure in regard to tackling environmental issues. Some of these treaties can be of great importance in helping solve the various environmental challenges and encourage environmental sustainability. These combined features also help them give a platform for countries to discuss and share information and stress on the fact that global cooperation and sharing of information are the key to protection of environment and public health. Even few of the most important international conventions are given below.

The United Nations Framework Convention on Climate Change (UNFCCC), 1992 The UNFCC, United Nations Framework Convention on Climate Change, the global convention on climate change was signed in 1992, with the aimed to returned and stabilize the atmospheric concentrations of greenhouse gases _foreword: dangerous anthropogenic interference with the global climate system ” must be avoided. The convention was operative after it was signed by 154 states at the United Nations Conference on Environment and Development, popularly referred as the Earth Summit also that was held in 1992 but came in effect on March 21, 1994. The primary goal of the of the UNFCCC is to avoid dangerous anthropogenic interference with the climate system, which is achieved through providing the constitution of climate change legislation as well as principles for global climate change cooperation.

The ultimate aim of the UNFCCC is to prevent the concentrations of greenhouse gases in the atmosphere from interfering with the Earth’s climate system in a damaging manner. This should be done in a manner that would do away with the need for ecosystems to be changed by an external force, ensure that food production is not at risk due to change in climate, and ensure sustainable economic development. If ecosystems need to be allowed to do their capacity to adapt to climate changes, if future food production needs to have other guarantees for not being compromised, if sustainable economic developments’ needs are to be met, then further scientific research is required as well as frequent meetings, negotiations and future agreements under the UN Framework Convention on Climate Change (UNFCCC).

UNFCCC has identified six focus areas of Climate Change for ACE: an abbreviation of Action for Climate Empowerment which the agency developed in 2015 in a move to advance the original wording of the Article 6 of the convention. Education, training, public awareness, public involvement, public access to information, and international cooperation when addressing these matters are the main groups of problems. It is necessary to stress that all the six categories are supposed to play an essential role in influencing the general understanding and participation of everyone in ACE. On the measures and actions to tackle climate change and its impact ACE asked governments to launch and implement education and publicity campaigns, offer training to management, technical and scientific employees, make information available and related engagement of the public.

It also encourages countries to engage in this process enhancing domestic institutions’ capacity as well as to share the experiences and improved lessons and practices. The Paris Accord signed in 2016 has come with the goal of ensuring that the global temperatures do not rise beyond 2 degrees Celsius above the levels that existed during the preindustrial period. The Authorities of the UNFCCC are at the moment in the process of implementing this agreement. Kyoto Protocol was adopted by the UNFCCC in 1997 and came into force in 2005 and expired in 2020 replaced by the Paris Agreement. The first bundle of measures of the UNFCCC was the Kyoto Protocol committing industrialised and marketeconomy transition countries to production reductions of specified amounts of six greenhouse gases.

In line with Article 4 of the Paris Agreement, all the parties are expected to, pursuant to their NDCs, prepare, communicate and update their plans as they relate to climate change mitigation. In addition to international mitigation accounting, the stocktake also includes aggregate communication and revision of progress of strategies for mitigation, adaptation, and implementation every five years. Thus, the most famous of the current international agreements is the United Nations Framework Convention on Climate Change, where 198 parties participate. The COP is the highest policy-making organ of the convention and meets every year while other sessions such as the regional and technical meetings are all year through. As the COP, it also measures the extent of compliance of the convention to identify if concerns and conclusions have to be adapted to enhance compliance.

To this end, the COP also assesses the parties and evaluates the additional measures necessary to achieve the target of the convention. In other words, the United Nations Framework Convention on Climate Change (UNFCCC) is another significant international agreement whose aim is to maintain the atmospheric concentrations of greenhouse gases in order to prevent anthropogenic interference with the climate system. 1 Rio Summit (Earth Summit) In 1992, a major United Nations Conference on Environment and Development UNCED also known as the Earth Summit was held in Rio de Janeiro. Hosted by the United States of America, the summit involved 172 nations, 2400 heads of the NGOs, and 179 leaders of the nation and government.

The Earth Summit was important because it saw the signing into agreements that include, the Convention on Biological Diversity; United Nations Framework Convention on Climate Change. 2 The Earth Summit popularly referred to as the Rio Conference 1992 held in Rio de Janeiro, Brazil aimed to design a new approach to global cooperation for management of the world’s natural resources as well as an ideal comprehensive plan. On this presupposition, the summit defined that complex problems of economic, social, and environmental nature might be solved with the help of sustainable development. It was formulated in the Rio Summit in 1992 and a minute noted that sustainable ecosystem could be achieved through sustainable development of the economy, social_BITMAP and environment.

Perhaps one of the most significant accomplishment of the Earth Summit was the endorsement of Agenda 21: partnership for sustainable development of the 21st century. A programme of action which was aimed at promoting a sustainable development known as Agenda 21 employed social and economic means to address environmental problems. For the progress of Implementation of Agenda 2113, the UN Commission on Sustainable Development was involved. On this occasion, the Rio declaration was passed which outlined 27 principles that have the status of principles of international law. The Rio Declaration simply restated the principles of sustainable development and drew a plan on how to manage the global economic and environmental challenges. Also during the Rio Earth Summit many measures that would help reduce the levels of global warming and its impacts to the whole world were launched.

When the goal of the meeting was to establish the UN Framework Convention on Climate Change to prevent further accumulation of green house gases to the atmosphere. However, the legal principle on the development and protection of forests was adopted due to the mentioning of importance of forests at the Earth Summit and was signed as the Rio Forest Principles. Nowadays, the issue of climate change and the depletion of the resources necessary for sustaining life is a burning question, for this reason, through the Forest Principles, they stimulate rational use and conservation of forests.

Another important aspect, which was seen during the Earth Summit, was necessary cooperation in the context of environmental and development problems at the global level. Therefore, some form of new structured and unstructured international cooperation forums were formed to monitor and facilitate the accords implementation. At the summit, the need for the industrialised countries to extend aid to the development and the environment in the developing countries was also underlined. However the summer aligned to the fact that the member states must endeavor to facilitate sustainable development for everybody. ‘Even today the Earth Summit is relevant as the world faces climate change, destruction of the biosphere, and sustainable development, its principles remained the crucial point in the world environmental and development policy.

3 Kyoto Protocol The UN CCC also underwent alteration in December 1997 by the ratification of Kyoto Protocol which is an international treaty. The goal of this Protocol was to cut on the greenhouse gases and their emission which are the global warming agents. While doubts regarding the efficiency of the agreement were existent, the treaty was considered the most important agreement of this kind in history. Between 2008 and 2012 most of the world’s industrialised nations including

41 countries and the EU were obliged to cut the emissions of six greenhouse gases to be 5.2%

below the 1990 levels. One of the options offered by the Protocol to meet the outlined targets was employing natural processes such as ‘sinks’ to eliminate the gases from the atmosphere like planting trees to absorb CO2. The Protocol indeed encouraged the industrialised countries to utilise the CDM to invest in structures and technologies into developing nations that would reduce emissions since the latter is full of opportunities. This way, investing nation may apply the effective reduction of emissions under the CDM to meet its obligations provided under the

Protocol. To assign an economic attribute to the greenhouse gas emission, emission trading was also permitted, which allowed member-nations to buy and sell emission rights. 4 Critics also argued that the Protocol failed to involve the United States particularly at the time when it ratified the Instrument that contributed to approximately one-quarter of the global emissions of greenhouse gases. For aforementioned economic factor, the US agreed on the Protocol but never ratified it. Nevertheless, the criticisms stated above notwithstanding, the Kyoto Protocol was a significant step forward in addressing climate change concerns. It led to more negotiations and set the legal groundwork for the decrease of greenhouse emissions.

5 In turn, the Protocol contributed to raising the level of concern with regards to climate change as well as augmenting the understanding of the need for international collaboration in addressing the issue. Paris Agreement The Paris agreement that can be legally compelled internationally is an example of an agreement on climate change. This was ratified on the 12th of December 2015 at the United Nations Framework Convention on Climate Change in Paris France during the United Nations Climate Change Conference abbreviated as COP21. On November 4, 2016, it became operative. For the first time in the process of the fight against climate change, an agreement to provide a legal framework where all the countries are obliged to participate equally to prepare and fight climate change and its impacts make Paris accord a turning point in the process of multilateral climate change.

The long-term low greenhouse gas emission development strategies (LT-LEDS) are called for to enhance the focus and to better fit the efforts into the long-term perspective called for by the Paris Agreement. LT-LEDS provides the long-term perspective to the NDCs. They are not as conventional as NDCs but will be covered in the subsequent section.

However, they provide a guidance and a sense of direction of future development as the NDCs are placed and framed into a States long-term development vision and strategic planning. The Paris Agreement which for the first time introduces provisions of ‘intended nationally determined contributions’ or voluntary contributions by other Parties repeats the provision that developed countries are under obligation to provide finance to the developing and the vulnerable countries. Because the required emission cuts require costly technical changes, climate finance is required for mitigation. 6 As climate change has serious impacts on our society and world and in order to combat these impacts and reduce the impacts we have to spend huge money funds for adaptation, climate finance is equally important for adaptation.

Climate change architecture now a death sentence for most humanity; which has come to be after the United States opted to withdraw from the Paris Agreement twice now, UN Climate Change chief Simon Stiell has said and expresse7 Such events were looked at based on the events of January 2015: three shooting terror incidents occurred in Île-de-France . From the twenty killed in the attack, three of them were reportedly attackers. The same year on the same nation on the 12 of November suicide bombers attacked a Beirut suburb of Lebanon leading to the death of forty-three persons. The next morning, 130 individuals died by the hands of terrorists who launched attacks in three different places in Paris. France very soon joined this war against terror and declared a three months emergency situation.

But a little over two weeks’ time, presidents and delegates from 196 nations convened in a city, which was and still remains in mourning to negotiate the broad general outcomes of what has become the Paris Agreement. It was seen by its creators as a political achievement precisely through enabling political participation despite the global affection for fossil Fuels, certainty, and the apparent achieved anarchy. 8 Conclusion Thus, for overcoming the world problems and achieving the goals of sustainable development the use of international environmental protection treaties is crucial. In the same way, the 1993enacted CBD seeks to promote sustainable use of biological resources and share fairly the benefits of genetic recourses. The interaction between challenges that relate to the environment

It shows they are gradually coming to grip with the realization that the conservation of the earth requires a united effort and not just a regional or national venture. But as the law stands there are challenges that relate to funding, compliance, and to an extent the implementation of the changes that have been procured. Thus, prerequisites for international cooperation have been developed due to the ratification of environmental conventions. But to bring those promises into effect, it is necessary to continue efforts, be open, and take responsibilities.

International treaties are still going to remain important in maintaining positive and sustainable future since the environment is under threat through degredation and climate change.
