Venugopala S.G, B.A.LL.B.., Practicing Advocate, Karnataka

ABSTRACT

The art of balancing contradictions between liberty and the gravity of offences has been, from a long ago is a fundamental task of judiciary. As per classic criminal jurisprudence, balanced grounds should to be followed while granting bail to the accused and such grounds should be based on proportionality, deterrence, rational choices. Previously in India, liberal approaches were being followed even while granting bail in cases where crimes are heinous in nature, which involve custodial violence and criminal conspiracy. The Liberal approaches have always carried risk of damaging the soul of criminal jurisprudence which aims to maintain social order. When the procedural aspects and discretion without rational scrutiny overpower the substantial deciding factors, the ultimate purpose of law fails.

In recent times, the courts have shifted from traditional grounds to dynamic, subject oriented and substantial issue concerned grounds for granting of bail. Instead of liberal approaches to grant bail, There has been structured, victim rights and social reflection oriented, tightened grounds are coming into effect. This paper examines various topics, including balance between rights and liberty of accused and gravity of offence. This paper also covered recent landmark judgment of Supreme Court of India on granting bail to Kannada actor Darshan relating to the murder of Renukaswamy emphasizing the deciding factors in establishing prima facie case, rights of victims of crime and the gray areas of criminal jurisprudence linking the same with the global perspectives.

Keywords: Criminal jurisprudence on bail, heinous crimes, social order, substantial issue, prima facie case, actor Darshan case.

INTRODUCTION:-

In India, the Rule of Law and the Right to Life and Personal Liberty are the key factors in deciding the constitutionality of a Specific Law, Ruling and a Judgment. The Rule of Law itself is a broader principle, its intersection with Right to Life and Personal Liberty expands its scope and opens doors for broader interpretations. The concept of bail which has its roots in personal liberty is no exception to the broader interpretation of Rule of Law. This article examines the Thoughtful Judicial deliberation through the Landmark decision by Supreme Court of India in State of Karnataka V/s Sri Darshan ETC. It is a critical breakdown of discretionary limits of judiciary and modern imperative to protect the dynamic concept of Rule of Law with the Scrutiny of Rational Proportionality.

STATE OF KARNATAKA V/S SRI DARSHAN ETC - THE BENCHMARK :- The appeal filed by the State of Karnataka in Supreme Court of India against the Bail granted to Kannada Actor Darshan by Karnataka High Court has set a landmark precedent as to applying mind to the facts and the method of viewing any case as “Prima Facie”. The Supreme Court has emphasized on the meaning of the term “Prima Facie” in precise manner citing various relevant case laws and also emphasized on circumstantial evidence, application of mind to the facts in order to avoid perverse conclusions. This ruling of Supreme Court will serve as a foothold of evolving Criminal Jurisprudence because of the following reasons. PRIMA FACIE - A PATH OF ACCEPTING THE APPARENT:- In general, Prima Facie means a fact which is based on what seems to be truth when it is seen or heard at first1.

In this case, the Honorable Supreme Court of India has elucidated the meaning of the term prima facie accentuating that the factors to prove the guilt of accused beyond reasonable doubt are the matters to be touched during the course of trial. The matters such as inconsistencies in the statements of witnesses, delay in stating the grounds of arrest to the accused, credibility of witnesses are the attempts to find the merits of the case which are too early to be touched during the matter of granting of bail. 2

The Supreme Court even though has observed the past judgments on serious inconsistencies in the reports, Considered this case of Actor Darshan on the overall analysis of the first sight. The Supreme Court has considered the Gravity of the offence i. e. , murder which is too horrifying in nature where the bail petitioners/accused are said to have roles in mutilating the body of the victim, a well executed conspiracy with the guilty mind, meeting of minds and the preparation including other evidences are all the facts which are established prima facie case against the accused. In this case, the Supreme Court has considered the charges against the accused and compared it with the materials produced on record, antecedent of the accused in proportionality with the scrutiny of due process of law and rationality.

The results of all these viewpoints suggests that, the Supreme Court has interpreted the meaning of the term “Prima Facie” in its literal sense combining it with other stronger factors as stated above creating more promising criteria for the future which can be called as “Prima facie threshold test”. CIRCUMSTANTIAL EVIDENCE – A CRUCIAL FACTOR TO DETERMINE CRIME:- The Black’s Law Dictionary defines that, circumstantial Evidences are the ones which inferentially proves the principal facts by establishing the conditions of surrounding circumstances, whose existence is a premise from which the existence of the principal fact may be concluded by necessary laws of reasoning. 3 In simple sense, circumstantial evidence is a indirect evidence that requires a rational assumption connecting it to a conclusion.

In this case, the Supreme Court has specifically stressed on failure of High Court of Karnataka to properly evaluate the “Chain of Circumstantial Evidence, including CCTV footage, Call records, Forensic Reports which mirrors the deliberate attempts of the accused to destroy the evidence”. 4 Here the Supreme Court has observed the Chain link of the events and how the facts and evidences produced on records orderly connected with each other. This chain of evidence is important in criminal cases, because in the absence of direct evidences, the circumstantial evidences can be sufficient to decide a case if they form a complete chain of events and facts which support each other unerringly to the accused’s guilt. In the event of such evidence, the chain link rules out any other reasonable hypothesis. In this case of Actor Darshan

the circumstantial evidences have formed chain in prima facie itself leaving no reasonable doubt for any other hypothesis or assumptions. PERSONAL LIBERTY AND CANCELLATION OF BAIL – THE CONFLICT:- The right to life and personal liberty which is the soul of Indian Constitution5 has the broader scope which connects with various human rights, setting standards for dignified life is a concerning and most critical issue while granting bail to the accused, because the courts have to weight both the sides i. e. , the rights of accused and case of accused, to come to a reasonable conclusion. The courts in various cases have stated that Liberty must be balanced against societal interest and fair administration and adjudication of criminal justice. 6 They further quoted that, the Right to liberty under article 21 is valuable but it is not completely absolute in nature7.

This view of Supreme Courts suggests that, Cancellation of bail is justified even by weighting the article 21 of Indian Constitution in the question. Because, in any case where the accused have tried to tamper the evidence or can influence the witnesses the bail can be cancelled8. This case of Actor Darshan throws light on the quote of Supreme Court where it stated “Freedom of bail cannot be allowed to be used as a license to subvert justice.

”9 All these views of Supreme Court suggests that, In the process of adjudication of justice in pre trial stage, balancing between the rights of accused and the severity of offences they are accused of AND the weight of evidences on record against the accused at first sight, which are forming chain link of circumstances leaving no room for any reasonable doubt are crucial aspects to decide whether the accused is entitled to be released on bail or not. POST BAIL MISCONDUCT – DISREGARD FOR JUDICIAL PROCESS:- After the Karnataka High Court granted bail to the accused, the acts of the accused such as socializing with the witnesses, participating in social events were contradictory to the pleadings made to grant the bail and the treatment for accused in custody have risen doubts in public domain about the Celebrity treatment.

The Supreme Court has considered these aspects impactful as this kind of incidents harms the faith of common people on Judiciary. As the Post-

bail conduct is a valid consideration to protect the integrity of investigation and trial, The Supreme Court has considered this misconduct of accused as detrimental. 10 EVOLVING CRIMINAL JURISPRUDENCE:- Previously The Indian system was based on England’s accused centric model, which lies on principle of Sir William Blackstone where he famously quoted “It is better that ten guilty persons escape than that one innocent suffer”. 11 The Global Criminal Jurisprudence is shifting from that old accused centric model to Justice centric model where individual and victim rights, accountability, fair trial and the integrity of justice systems are combined together to safeguard the principles of Rule of Law.

In this Actor Darshan’s case if we closely observe the Supreme Court has set aside the initial order of High Court not only for post bail misconduct, but it is because of crucial aspect that, the High Court has completely disregarded the material facts and has failed to come to a proportional and rational conclusion.

CONCLUSION:-

This case of Supreme Court has provided valuable guidelines to comprehensively deal with future Criminal Cases which involve heinous crimes, societal aspects. This case also sets a precedent regarding the view of Prima Facie case, appreciating the materials on record in the pre-trial stage and most importantly regarding the necessity of Courts to consider Rule and Purpose of Law with Interests of society. Even though in the matters where there are contradictions between evidences, witness statements this case serves as a guiding light, because it explains what are all the matters to be considered in the pre-trial stage of a criminal case.

While it is true that taking all the evidences into considerations and noting down principles and striking the balance between liberty and severity is challenging, The application of mind to the facts as well as legal principles have the power to overcome such challenges and to protect the Rule of Law.
