THE ROLE OF AI IN WITNESS PROTECTION: THE
FUTURE OF CRIMINAL JUSTICE ADMINISTRATION

ABSTRACT
Seven decades after India got its much-priced independence the judicial system has failed to instil confidence in the people. This is reflected in the absence of witness protection in India, despite following the adversarial system of justice administration. The colossal pending cases and the reluctance of the public to approach the courts bears evidence to this fact. It is widely acknowledged that The Indian Criminal Justice System suffers from a number of shortcomings which directly affect the uninterrupted and unhindered deliverance of justice. Witness Protection is one such area in need of robust reformation. Witnesses form an important pillar in any criminal prosecution and are an indispensable part. A major part of the case depends on the testimony of the witnesses.
As a result, this particular category of people turns vulnerable due to the sensitivity of the information they are carrying with them. In India many cases are reported against witnesses getting brutally assaulted and getting threats for destruction of life and property. Witness protection is an unexplored area with minimal scholarly attributes. Artificial Intelligence, the field of technology that aims at building programmed machinery that claims to replace human intelligence, has reached every corner of the country and several experiments are being conducted nationwide to use AI for the betterment of different working fields. With the increasing advent of Artificial Intelligence there has been several scholarly attributes towards the usefulness of AI in different fields including law.
This paper makes an attempt to study the various methods of AI like predictive analysis and voice cloning securing anonymity with the objective of increased witness protection along with the probable disadvantages of the same.
INTRODUCTION
“A trial without witnesses, when it involves a criminal accusation, a criminal matter, is not a true trial” - Bill Mc Collum1 The Indian Criminal Justice system undeniably relies on the above quoted lines in its administration of justice. Since the pre-Vedic area throughout the medieval era, we have seen the immense dependence of the criminal trial on a witness. They form the strongest pillars of a criminal sentencing. However, amongst all the innumerable shortcomings in the Indian Judiciary system which directly affect the uninterrupted deliverance of justice, witness protection and rehabilitation is one area which is in the need of a robust reformation. In India it is quite a seldom sight that a common man is zestfully participating in police and court related matters.
Ironically, witnesses, being the foundation of a just, fair and almost accurate criminal trial, are most often the most reluctant to appear and testify in the court, ‘especially in cases where the witnesses are required to testify against individuals who are influential. ’2To state precisely, we owe this diffidence to the vulnerability that these witnesses are exposed to time and again. Witnesses are an indispensable part and play a pivotal role in any criminal prosecution. As a result, they quite often remain vulnerable, owing to the sensitivity of the information they are carrying with them. Quite surprisingly, India does not have a statutory enactment for Witness protection and rehabilitation, the only authority in this regard being ‘The Witness Protection Scheme, 2018’’.
Data shows even after 2018, the rate of hostile witnesses in criminal cases in India continue to remain as high as 17% in a year. This poses a question to our judiciary as to the cause of such reluctance in the masses to become witnesses in a Criminal Trial. The answer to the problem lies in the identification of the cause of such phenomena in the Indian citizens. When it comes to Witness Protection, there is no debate upon the fact that India is in a sorry state. The reality however harsh and peculiar is that a country like India was devoid of any legal witness protection for seventy-one years after its much-coveted independence and this

bears evidence to the sheer negligence of the legal fraternity towards this magnanimous ailment of the Judiciary System. It was only in 2018, the Supreme Court of India, while giving the verdict of the 2016 case of Mahender Chawla v/s Union of India3 realised the utmost importance to have a statutory protection for the witness in a criminal trial, thereby directing the States and Union Territories to enforce the Witness Protection scheme, 2018 in “letter and spirit” 4. Embraced by the Indian legal fraternity as a breath of fresh air, the problems aimed to be addressed by this Scheme remains far fetched till the present day. Several cases and the observation of the Courts in those cases bear testimony to this fact.
On 19th January, 2021, the Aurangabad bench of the Bombay High Court, terming the problem of Hostile witness as “cancerous to the rule of law and the justice delivery system”5 observed that the Courts cannot “turn a blind eye to the menace of hostile witnesses and we cannot find ourselves helpless as against the conduct of the hostile witnesses” 6 The Court directed the Trial courts to take actions against the five hostile witnesses, the testimony of whom resulted in the acquittal of the accused woman who was found to be guilty and convicted in this case, under section 340 of the Criminal Procedure Code. However, it is not fair to hold these witnesses absolutely responsible since the root cause of witnesses turning hostile remains unresolved and untreated at the grassroot level.
In this same case, the Court has further observed that: “We are finding practically in every case before us that day by day, the list of hostile witnesses is getting emboldened in turning hostile for the reasons which can be speculated and perceived”7 It must be noted with a sense of penitence that the situation rather than improving has worsened after the order directing the adoption and implementation of the Witness Protection Scheme, 2018. The recent case of Lakhimpur Kheri Violence8 is a fateful but perfect example why witnesses

in India are not ready to be present in the Court with their testimony and how they have to ‘ask’ for protection- something that is their inherent rights as witnesses and the administration should grant to them with full responsibility on their part. Despite several directions of the Honourable Court why is it that the system is failing to protect the most important pillars of the criminal justice administration system? In October, 2021, The Honourable Supreme Court of India expressed astonishment towards the fact that amongst the hundreds of eye witnesses present during the culpable incident, only twenty-three witnesses were traced and brough to the court. The incidents of threats and attacks to the key victims were reported in March and April 2022.
One of the key witnesses of the case reported to the police of receiving threat letters if he furthers testify in the court against the accused and was later attacked and received several injuries as a result. Several such incidents pose question on the absence of a statutory provision for Witness Protection and the sufficiency of the existing scheme. The glaring lacunae in the existing scheme, if not addressed soon, will result in the dispersion of this cancerous ailment named Hostile Witness. Witnesses - The eyes and ears of justice? The simple legal meaning of the term Witness is a person who gives evidence in the Court of law on oath or affirmation. A witness is someone who is well acquainted with the fact of the case and has first-hand information about the crime through any of his/her senses like eyes, ears, touch etc.
The concept of Witness can be traced back to as early as the ancient Hindu Law. The Dharmasutras contain how witnesses are to be examined and tested. Under the Hindu Law of Crimes, two types of proofs were considered valid- Human Proof which consisted of documents (lekhya), witnesses (sakshi) and possession (bhukti). The second form of proof is the Divine Proof. The Human Proof has always been preferred over the Divine Proof. The Code of Criminal Procedure 1908 and The Indian Evidence Act 1872 do not give us any formal definition of the term Witness. Black’s Law Dictionary defines the term Witness as: “In the primary sense of the word, a witness is a person who has knowledge of an event. As the most direct mode of acquiring knowledge of an event is by seeing it, "witness" has acquired the
sense of a person who is present at and observes a transaction. ” 9 The Indian Evidence Act 1872 under sections 118 states “Who may testify”. The section states that any person is competent to be a witness if he or she is able to comprehend the questions put by the Court and are able to answer them. Sections 118-132 of the said Act deals with who can be witness, how they can testify, and examination of witnesses etc. The Witness Protection Scheme 2018 defines the term Witness under clause 2 (k) in the following words, “Witness’ means any person, who possesses information or document about any crime regarded by the competent authority as being material to any Criminal proceedings and who has made a statement, or who has given or agreed or is required to give evidence in relation to such proceedings.
”10 Every Criminal justice system in the World is based on either Adversarial System or Inquisitorial System. India having adopted the Common Law from the British Judicial System in its dispensation of justice follows the adversarial system; whereby witnesses play a very important role. In Vikash Kumar Roorkewal vs State of Uttarakhand,11 the Hon’bl Supreme Court of India emphasized on the importance of witnesses in Criminal Trial by stating that protection of witnesses through legislative measures can go a long way in conducting a fair trial, “The witness should be treated with great respect and consideration as a guest of honour. ”12
WITNESS PROTECTION - THE CURRENT STATE IN INDIA
As stated by Jeremy Bentham, "Witnesses are the eyes and ears of Justice." 13They are the most indispensable part of our Indian Judicial system, as the whole trial of a case depends upon the major factors, and witness testimony can be regarded as a supreme condition in our adversarial system of law. Ensuring a free, conducive environment without any threat, intimidation, or injury therefore acts as a catalyst of the criminal judicial process.

The breakthrough came in 2018 when the Supreme Court in the Mahender Chawla14 case declared the Witness Protection Scheme law until the parliament or various State governments prepared or notified their Witness Protection Schemes. Despite the various provisions of law present in the Indian Penal Code, Criminal Procedure Code, and Indian Evidence Act which recognize the intimidating affair of witnesses and their vulnerable condition and provide little support a full-fledged legislative framework was required that would help the witness to come out of their shell and present their testimony in a hostile -free environment. The judicial framework was kept in mind while constructing the new law of crimes in 2023.
The Witness Protection Scheme of 2018 is regarded as a significant approach towards the protection of witnesses as it categorized witnesses into three categories as per threat perception15- Category A- Where the threats of such nature extend to the witness's life or his family members during the investigation /trial or after that. Category B- Where the threats of such nature extend to the safety, reputation, or property of witnesses or family members during the investigation /trial or after that. Category C- Where the threat is mild of such nature likely to cause harassment or intimidation of the witness or his family members, reputation, or property, during the procedure of investigation/ trial or thereafter.
Another feature of this scheme is the Witness Protection Fund which directs each state to establish a fund to cover expenses for enforcement of the scheme, relocation, arrangements of security and other measures for protection Witnesses can apply for protection through the District Legal Service Authority which assesses the threat and decide the level of protection needed. Relocation of witnesses to a safe – hub, providing security, concealing the identity of witnesses, modulation of their voice and appearances during testimony, in camera proceedings

recommended which would act as a bar for the disclosure of the identity of witnesses, the testimony, and their personality to keep as confidential. Although, the scheme protects witnesses the major drawbacks it faces because of lack of awareness, inadequate funding, delays in approval by other States as well enforcement issues. 16 In comparison to the global scheme for the protection of witnesses, The U. S government provides comprehensive assistance and long-term protection through a re-integration process; it has proven to be a successful framework by providing a high success rate and robust legal framework under the Witness Protection Act, 1970, whereas the U. K. government protect witness through their Organized crime and Police Act,2005.
It focuses on relocation anonymity and psychological support, provides legal and financial aid, and maintains an equilibrium between witness anonymity and fair trial for the accused.
The law of crimes, which was enacted in 2023, specifically deals with the witness protection scheme in a more comprehensive manner under section 232 than its counterparts, as added in Bhartiya Nyaya Sanhita, the new law has a responsive legal framework, aligning with judicial observations as earlier stated in Indian Penal Code under Section 195A, threatening any person to give false evidence would amount to punishable up to 7 years or fine or both such punishment and law were changed in BNS, another important provision for witness safety added in Bhartiya Nagarik Suraksha Sanhita under Section 398 which clearly says its, Mandatory for every State Government to prepare and notify a witness protection Scheme another important feature in regard of witness protection scheme has been added in Bhartiya Sakshya Adhiniyam under section 55 which emphasis on oral shreds of evidence by witnesses in different circumstances and its relevance during trial.

WITNESS VULNERABILITY AND INCREASING NEED FOR PROTECTION
Witness vulnerability is a serious question that arises both in civil and criminal justice and the socio-legal sphere; vulnerable witnesses may face serious threats, intimidation, retaliation, or coercion from preparators or their accessories18, this vulnerability acts as an impediment to the witnesses to coming forward and undermines the justice process, protection measures act as a

shield that ensures that witnesses can safely participate in legal proceedings without danger or intimidation
TYPES OF WITNESS VULNERABILITY
Physical Risk-In circumstances where organized crime is involved, such as terrorism or corruption, witnesses may be at risk of death or physical injury if they testify. 19 Psychological Impact-where the situation arises, the trial of the case is based on the testimony of witnesses, but such witnesses are deterred from coming forward because of the trauma, severe psychological stress, or long-term mental health issues. Social Consequences -In a society where a close-knit relationship is followed if some witnesses come forward and reveal the truth, they can be bashed or harassed or damage their personal reputation.
Need for Protection Protection programs arise from fear that the witnesses may turn hostile or retract their statements if they feel trepidation, protection measures act as a cover for them to come forward and testify their facts and to deliver justice, if wholesome measures are not there they would be silenced and agree to compromise on legal procedure. Various programs for the protection of witnesses have been introduced by different agencies of government which provide physical protection, concealing of identity, and financial aid to support them from attacks. Many countries like the United States, the UK, and Australia established robust programs that provide complete closure to witnesses.
Protection of testimonials is of paramount significance which includes video record, closed-circuit television for courtroom testimony, and incognito reporting to conceal the identity of witnesses. Laws should be more stagnant which protect and immune the witnesses from any retaliation and incognito their identity from any public records. Although protecting witnesses is a primary concern the key challenges faced by government agencies because of resource constraints, international cooperation, and adverse effects on the 19 Smith , J. judicial system. Significance of Witness Data Confidentiality and Anonymity The confidentiality and anonymity of witness data hold significant importance in various contexts, particularly within legal, investigative, and security frameworks. The following points outline their critical role:
1. Ensuring Witness Safety
Witnesses may encounter threats, harassment, or harm from individuals or groups related to their testimony or information. • Safeguarding their identity mitigates risks and protects both their personal and familial safety.
2. Encouraging Witness Participation
Numerous individuals may be reluctant to provide essential information due to fears of exposure or potential repercussions. • Assuring anonymity can inspire witnesses to come forward with information without the dread of retaliation or public scrutiny.
3. Preserving the Integrity of Investigations
The unauthorized release or mishandling of witness data can jeopardize ongoing investigations, alert suspects, or result in evidence tampering. • Confidentiality helps maintain the focus and impartiality of the investigation.
4. Preventing Social and Professional Consequences
In sensitive situations, such as whistleblowing, witnesses may experience professional disadvantages, social exclusion, or stigmatization if their identities are revealed. • Anonymity enables them to disclose their insights without jeopardizing their reputation or career.
5. Advancing Justice and Accountability
Witnesses are essential in revealing the truth and promoting justice. Protecting their confidentiality ensures that their testimony remains uninfluenced and intact. • Anonymity contributes to the preservation of impartiality and fairness in legal processes.
6. Adhering to Legal and Ethical Standards
Numerous legal systems and organizations are obligated by laws and ethical principles to safeguard witness data, ensuring compliance with privacy regulations and fostering public trust. Key Practices for Upholding Confidentiality and Anonymity: • Secure Data Management: Implementing encryption and restricting access to sensitive witness information. • Non-Disclosure Agreements (NDAs): Ensuring that individuals managing witness data are bound to confidentiality. IMPORTANCE OF WITNESS DATA CONFIDENTIALITY-Call of the hour? There can be no denial whatsoever of the palpable sense of disinclination, even loathsomeness, in the Indian population to approach the court or to get involved in judicial matters especially as witnesses of a criminal trial.
The reason behind India’s rising rate of hostile witnesses or witnesses not turning up resulting in the lowest of conviction rates as compared to other federal contemporary societies is mostly this peculiar hesitant approach of people towards criminal proceedings. This is the consequence of a glaring absence of a proper witness protection, quite unusually considering the vastness of the democracy. The presence of a proper witness protection program (WPP) in the line of the likes in USA, will not only instil confidence in the people but will also speed up the justice administration system by giving a boost to the conviction rates. One of the ways in which this can be achieved by providing a efficient system of witness identity protection.
This point was first mentioned in the 14th Law Commission of India in 1958 and more sincerely discussed in the 198th Law Commission report of 2016, whereby it was specifically said to include ‘witness identity protection program’ under the
Witness protection scheme. AI in this regard has an enormous potential. With the rise of digital technologies, particularly artificial intelligence (AI), there are new and enhanced methods to protect witness identities and sensitive information. AI offers advanced tools for maintaining the confidentiality and anonymity of witness data, ensuring that these individuals can testify without fear of exposure.
1. AI in Data Encryption and Secure Communication
One of the most important aspects of maintaining witness data confidentiality is ensuring that all communications, personal details, and case information remain secure from unauthorized access. AI enhances encryption protocols by making them more complex and difficult to breach. AI-driven encryption algorithms provide an additional layer of security to protect witness identities and sensitive data from cybercriminals, hackers, or even unauthorized personnel. AI can also monitor communication channels, such as emails, phone calls, or text messages, to ensure that no unauthorized attempts are made to intercept or extract confidential information. By analyzing metadata patterns, AI systems can identify unusual behavior that might signal a data breach or cyberattack, alerting security personnel in real time to potential threats.
This proactive approach minimizes the risk of witness data leak. 20
2. Anonymity through Identity Masking
Witnesses often need to assume new identities to protect themselves from retaliation. AI plays a critical role in the identity masking process. By analyzing large datasets, AI can create realistic, yet untraceable, identities for witnesses, including generating new personal details such as names, addresses, and even digital footprints. AI-driven tools can ensure that new identities are indistinguishable from legitimate profiles in public and private databases, thus safeguarding the witness's anonymity. In the digital age, AI tools can further prevent the exposure of witness identities by managing their digital footprints. AI systems can track and monitor the use of personal information across 20 Aishpreet Kaur Devgan, ‘AI-Driven Cybersecurity for Witness Data: Confidentiality Redefined’, International Journal of Research Publication and Reviews Journal homepage: www. ijrpr.

the internet, including social media platforms, government databases, and private systems. If a witness's information is inadvertently exposed, AI can flag and remove it from these platforms, helping to prevent identity theft or other malicious attempts to uncover their real identity.21
3. AI and Anonymized Data in Legal Systems
When a witness's testimony is required for legal proceedings, it is crucial that their identity remains protected throughout the process. AI technologies allow for the anonymization of witness data in court records, investigations, and case files. Natural Language Processing (NLP), a subset of AI, can automatically detect and redact personally identifiable information (PII) from legal documents, ensuring that sensitive data is kept confidential.22 For instance, AI can automatically redact the names, addresses, or other personal details of witnesses from digital records, ensuring that only the necessary information is accessible to authorized individuals. This approach reduces human error and ensures that witness anonymity is upheld throughout the judicial process.
4. Facial Recognition and Identity Protection
Facial recognition technology, powered by AI, plays a significant role in protecting the identities of witnesses in situations where their physical presence is required, such as in courtrooms or public hearings. AI can be used to alter the appearance of witnesses in video feeds, such as blurring faces or modifying their voice, so that their identity remains concealed from the public, jurors, or others present in the room. Additionally, AI can be employed to identify unauthorized individuals who may attempt to gain access to protected witnesses or their location. By analyzing real-time footage from surveillance cameras, AI systems can detect faces or behaviors that may indicate potential threats, alerting security personnel to take appropriate action.
5. Voice Cloning to protect anonymity
The voice cloning technology aims at modifying the voice of witnesses and thereby not

revealing their identity. Voice plays an important role in criminal trials, especially in cases related to women and children and sexual offences, and can face difficulty in alretarions. As discussed before, identity revelation is the area of concern when it comes to protection of witnesses. The vulnerability is multiplied if the true identity of witnesses, especially in criminal cases, is revealed making them exposed to the risks of threats, inducements and other factors. AI voice generators offers a solution to this problem23 by altering the voices of witnesses testifying in a criminal trial by generating a modified voice different from the original one and hence protecting the anonymity quite easily.
ROLE OF AI IN WITNESS PROTECTION- Safeguarding lives through technology The role that a witness plays in the criminal justice administration system, especially in a country like India that follows the adversarial system of justice administration, make them as vulnerable as the victims. Having established the vulnerability of witnesses in the preceding chapters let us now try to look for efficient solution in the area of technology. Artificial Intelligence needs no introduction in the contemporary society anymore. From a small village to the sky rise tech savvy offices- everyone is well aware of what AI is. AI is everywhere! It is a form of advanced technology that attempts to simulate human intelligence and thus making way for a time saving and efficient method of working as compared to traditional methods.
However, amidst the debate as to whether AI, like all technological advancements, is a boon or a bane, we cannot deny the fact that AI has added a paradigm shift in the fabric of work all over the World. The role of AI has spread in all dimensions of human life including education, medicine and health, entertainment and several such fields. The central theme of this paper is to analyse the uses of AI that can solve the problems faced by criminal justice administration, especially in India and to infer whether AI can really change the current deplorable plight of witness protection in India. Witness protection programs (WPPs) are crucial to ensuring the safety of individuals who provide critical testimony in criminal cases, particularly when facing threats from organized crime.
Traditionally, witness protection has involved relocating individuals, changing their identities, and offering physical protection. However, as technology advances, artificial
23 Ibid
intelligence (AI) is increasingly playing a significant role in enhancing the security and efficiency of these programs. The following points make an attempt to explore the growing role of AI in witness protection and how its applications are reshaping these efforts.
1. AI-Powered Surveillance Systems
AI technologies, particularly facial recognition and behavior analysis, are transforming the effectiveness of surveillance systems used in witness protection. Traditional security systems, such as static cameras or human guards, are often limited by human error or a lack of real-time analysis. AI, on the other hand, can continuously monitor environments and detect subtle signs of potential threats. For instance, AI-powered surveillance systems can recognize faces from video feeds and flag suspicious individuals or groups, allowing law enforcement to respond proactively. These systems can also track behavioral patterns, such as unusual movement around a protected witness’s residence or public spaces, signalling potential threats before they manifest.
This realtime analysis is vital for enhancing the protection of individuals under threat, especially when they are placed in high-risk environments. 24
2. Predictive Analytics for Threat Assessment
AI’s predictive capabilities can significantly improve threat assessment processes within witness protection. Using machine learning algorithms, AI can analyse large datasets from various sources, such as social media, phone records, and criminal activities, to identify potential risks. By studying patterns in behavior and criminal activity, AI systems can predict where and when threats to witnesses are most likely to occur. For example, if a criminal organization begins targeting a witness through social media or phone communications, AI can detect these patterns early, alerting law enforcement to the impending risk. Additionally, AI’s ability to continuously learn and adapt as it processes more data allows for more accurate and timely threat predictions, ensuring that the necessary 24 Hennig, F. , & Malm, A. (2019). The Role of AI in Crime Prevention and Witness Protection.

protective measures are put in place before harm occurs.25
3. Securing Digital Communications and Identity Protection
In today’s interconnected world, digital communication and online activity pose significant risks to the security of protected witnesses. AI can help safeguard these aspects by utilizing advanced encryption algorithms and secure messaging systems. AI-powered systems can ensure that communications between witnesses and law enforcement are protected from interception and unauthorized access. Furthermore, AI can monitor digital platforms for any signs of an accidental leak of the witness's identity or location. The process of creating a new identity for a protected witness can also be bolstered by AI tools. AI can monitor various digital platforms for any unauthorized use of sensitive information, alerting agencies if a breach is detected.
Additionally, AI-driven digital tools can offer encrypted communication channels that prevent malicious actors from intercepting or deciphering sensitive information. Moreover, AI can manage and protect a witness's online footprint, ensuring their digital identity remains anonymous and secure. 26
4. Ethical and Privacy Considerations
While AI offers numerous benefits for witness protection, its integration into these systems raises significant ethical and privacy concerns. For example, the widespread use of AI-powered surveillance, particularly facial recognition, has raised concerns about potential abuses and violations of personal privacy. In some cases, these technologies could be used for oversurveillance, extending beyond their intended purpose of protecting witnesses. AI systems can also exhibit biases, particularly in facial recognition technology. Studies have shown that AI systems may be less accurate in identifying people of color or women, leading to the potential for false identification. Such errors could inadvertently compromise the safety of the witness they are designed to protect.
Therefore, it is essential that AI technologies used in witness protection are rigorously tested for accuracy and fairness to avoid undermining their 25 Pérez, J. , & Wang, L. (2020). AI Surveillance in Urban Areas: Opportunities and Ethical Risks. Journal of Ethics in Technology, 15(1), 56-70.

effectiveness. Additionally, strict privacy protocols must be established to ensure that sensitive data related to witnesses is not misused or exposed.27
5. AI in Psychological Support and Risk Management
Beyond physical and digital protection, AI can also provide psychological support to witnesses under protection. The emotional toll of participating in criminal investigations or court proceedings can be significant, and AI tools can help monitor a witness’s psychological state through analysis of voice patterns, speech content, and behavioral cues. By detecting signs of stress, fear, or anxiety, AI can alert authorities to the need for psychological intervention, ensuring the witness receives the necessary support. Additionally, AI systems can simulate various risk scenarios to help witnesses understand how they might inadvertently compromise their safety. By analyzing social interactions, online behavior, or routine activities, AI can identify potential security breaches and help witnesses adjust their behavior accordingly.
This proactive approach to risk management can reduce the likelihood of witnesses making mistakes that could expose them to harm. 28
6. Improved Coordination and Resource Allocation
Witness protection often involves coordination between multiple law enforcement agencies, especially when witnesses need to be relocated or monitored across different jurisdictions. AI can facilitate better communication and data sharing between agencies, ensuring that witness safety is maintained at all times. AI systems can track witness locations, monitor for threats, and update relevant authorities in real-time, making coordination more seamless. Furthermore, AI can optimize resource allocation by analyzing patterns and determining the most effective use of available resources. For example, AI can analyze crime data and geographic information to suggest the safest possible relocation areas for a witness. This datadriven approach ensures that decisions are made based on real evidence, enhancing the 27 Turner, S. , & Roberts, P. (2022).

protection offered to witnesses.29
CHALLENGES AND CONCERNS
While Artificial Intelligence (AI) offers significant advancements in safeguarding witness data and ensuring anonymity in witness protection programs, its integration also raises various challenges and concerns. These issues range from technical limitations to ethical and legal considerations. As AI continues to evolve, it is essential to address these challenges to ensure that the benefits of AI in witness protection are realized without compromising privacy, security, and fairness. There are in fact several debates prevailing around the challenges faced in implementing AI in the legal and judicial systems in a country like India. In its peak working ability, AI definitely is a boon of technology but however it must also be noted that the implications of error made commonly by AI have the risk of having huge ramifications that would adversely effect the lives and liberties of people30.
The recent data leak of over crores of customers of Star Health Insurance is a glaring example of how dangerously vulnerable we are when it comes of data confidentiality. Amongst several factors, below are few challenges and concerned discussed as found in different scholarly attributes in this area.
1. Data Privacy and Security Risks
AI systems rely heavily on large datasets to function effectively, which means they need access to vast amounts of personal and sensitive information. In witness protection programs, this data often includes confidential personal details, case information, and even biometric data like facial recognition or voice patterns. The security of this data is paramount, as any data breach or unauthorized access could put witnesses at risk. Although AI can enhance encryption and data protection protocols, the very nature of AI systems makes them susceptible to cyberattacks. Hackers could exploit vulnerabilities in AIdriven systems to gain access to sensitive witness data, leading to potential exposure of protected identities. Furthermore, if AI algorithms are not properly configured, they may 29 Goodman, M. , & Kohn, D. (2020). AI, Data Privacy, and Ethical Concerns in Modern Surveillance.
Ethics in Technology, 14(2), 102-118. 30 https://www. barandbench. com/columns/artificial-intelligence-in-context-of-legal-profession-and-indianjudicial-system (last visited on 10/12/2024)
inadvertently store or share personal data in ways that were not intended, exposing the very individuals they are meant to protect.
2. Bias and Accuracy in AI Algorithms
AI systems are only as good as the data they are trained on. If the training data is biased or incomplete, the AI model can produce inaccurate or unfair results. In the context of witness protection, AI-powered tools such as facial recognition and identity masking could potentially fail to properly protect witnesses due to algorithmic biases. For example, AI systems trained on non-diverse datasets may have lower accuracy in identifying individuals from certain racial or ethnic backgrounds, leading to misidentification or even wrongful exposure. In cases where AI is used to redact personal information from legal documents or communications, biases in the model could result in inconsistent redaction, where some sensitive information may be overlooked or incorrectly deleted. This undermines the confidentiality of witness data and may expose their identities inadvertently.
3. Ethical Issues in Surveillance and Overreach
One of the most significant ethical concerns with AI in witness protection is the potential for over-surveillance. AI technologies, such as facial recognition and behavioral analysis, can track and monitor individuals, including witnesses, law enforcement personnel, and the general public. While this can be useful for identifying threats to witnesses, it raises questions about the balance between protecting individuals and respecting privacy rights. The use of AI for surveillance could extend beyond witness protection, leading to invasive monitoring practices that infringe on personal freedoms. AI systems capable of tracking and analyzing large volumes of data could result in constant surveillance of protected witnesses, which, although intended to protect them, might feel like an infringement on their autonomy and privacy.
Without proper checks and balances, the deployment of AI in these scenarios could lead to abuses of power and violate civil rights.
4. Transparency and Accountability in AI Decisions
Another challenge is the lack of transparency in AI decision-making processes. AI systems, particularly those based on machine learning and deep learning, often function as "black boxes"
where the decision-making process is not easily understood by humans. In the context of witness protection, it is crucial that AI systems used to protect identities or manage sensitive data are transparent and auditable. For example, if an AI system inadvertently exposes a witness's identity or fails to detect a threat, it can be difficult to determine why the mistake occurred or who is responsible for the failure. This lack of transparency creates accountability issues. Witness protection programs rely on a chain of trust, and if AI systems are not fully understood or held accountable, it could undermine confidence in these technologies and pose risks to the safety of protected witnesses.
5. Dependence on AI Technology and System Failures
While AI can offer tremendous benefits, it also creates a potential over-reliance on automated systems. If witness protection programs depend too heavily on AI without sufficient human oversight, a system failure or malfunction could jeopardize the safety of witnesses. For instance, a flaw in AI algorithms could result in a failure to properly mask a witness’s identity or predict a potential threat, exposing the individual to harm. Moreover, as AI technologies continue to evolve, there may be a risk of obsolescence. Older AI models may no longer be effective against new threats, and systems that once provided protection may become vulnerable. This necessitates continuous updates, monitoring, and human intervention to ensure the ongoing safety of witnesses. Programs that rely on outdated or poorly maintained AI systems could be less effective at mitigating risks.
6. Legal and Regulatory Challenges
The use of AI in witness protection programs must comply with legal and regulatory frameworks, which vary across jurisdictions. Different countries and regions have different laws regarding data privacy, surveillance, and AI ethics. The deployment of AI technologies in sensitive areas like witness protection must ensure compliance with these laws, which can be a complex and evolving landscape. For example, AI tools like facial recognition or data redaction may be subject to strict data protection laws such as the European Union’s General Data Protection Regulation (GDPR). If AI systems inadvertently violate these laws, it could lead to legal challenges and penalties.
Additionally, the use of AI in cross-border witness protection programs may raise concerns regarding data sovereignty and international legal cooperation.
7. Cost and Resource Allocation
Implementing AI in witness protection programs can be costly and resource-intensive. Developing and maintaining sophisticated AI tools, such as facial recognition systems, encrypted communication networks, and data redaction algorithms, requires significant investment. This could place a financial burden on law enforcement agencies, particularly in jurisdictions with limited budgets. Furthermore, training law enforcement personnel to use AI systems effectively and to address any potential failures or biases in the technology requires ongoing investment in education and training. Without the necessary funding and resources, AI solutions may not be deployed effectively, leaving witness protection programs vulnerable to failure.
CONCLUSION
AI has become an indispensable tool in modern witness protection programs, offering advanced technologies to maintain confidentiality, ensure anonymity, and prevent data breaches. From encrypting communications to masking identities and predicting threats, AI provides comprehensive solutions for safeguarding witness data. However, as AI continues to evolve, it is essential that its deployment is balanced with careful consideration of ethical standards and privacy concerns. When used responsibly, AI can significantly enhance the safety and effectiveness of witness protection efforts, ensuring that those who testify against criminals can do so without fear for their lives. While AI holds the potential to revolutionize witness protection programs by enhancing data confidentiality, safeguarding anonymity, and predicting threats, its use also comes with significant challenges and concerns.
From data security risks and algorithmic biases to ethical dilemmas surrounding surveillance and transparency, the integration of AI in witness protection must be approached with caution. It is essential to implement robust safeguards, ensure transparency in AI decision-making, and maintain a balance between technological innovation and the protection of privacy and civil rights. Only through careful regulation, continuous
monitoring, and responsible use can AI be fully leveraged to improve the safety and effectiveness of witness protection programs.
