IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr. Rev. No. 657 of 2024 Krishna Mahto @ Krishna Kumar Mahto, age 27 years, S/O- Gobardhan Mahto, R/O- Village Siddi, P. O. & P. S. -Hundur, District Ranchi (Jharkhand)Pin-835217. … …Revisionist(s)/ Petitioner(s) Versus The State of Jharkhand … … Opp. Party(s) CORAM: HON’BLE MR. JUSTICE RAJESH KUMAR --- For the Revisionist(s)/Petitioner(s) : Mr. Amit Raj, Adv. For the State : Mr. S. K. Sinha, A. P. P. --- 04/19. 12. 2024: Heard. 2. Present criminal revision has been filed against the order dated 13. 05. 2024 passed by Addl. Judicial Commissioner-XV-cum-FTC (CAW), Ranchi, in S. T. Case No. 280 of 2024 arising out of Mahita Thana P. S. Case No. 55 of 2023 whereby prayer for discharge has been rejected. 3. It has been submitted by the counsel for the revisionist that the alleged victim is a married lady and as such, false pretext of marriage is nothing but useless allegation.
Both parties are major and it is consensual relationship and no offence is made out. Further, relationship is continuing for quite a long period and as such, allegation as alleged, is nothing but pressure tactics for other purpose. 4. Having heard learned counsel for the parties and on perusal of the records, it appears that the victim has made specific allegation that she was having good relationship with this revisionist but without her consent, sexual relationship has been established by force. This allegation constitutes the crime. 5. At this stage, veracity of the allegation cannot be looked into. 6. In view of the above discussions. I am not inclined to interfere with the impugned order. Accordingly, it is hereby, dismissed. 7. However, the revisionist(s) is at liberty to take all the plea(s) in the pending trial. (Rajesh Kumar, J. ) Ravi/- Uploaded
