(Lodged In Central Jail, Udaipur) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent [2025:RJ-JD:6509] (2 of 4) [CRLMB-894/2025] For Petitioner(s) : Mr. Deepak Menaria Mr. Ojas Shakdwipeeya For Respondent(s) : Mr. Lalit Kishore Sen, PP Mr. Naresh Singh for Complainant HON'BLE MR. JUSTICE KULDEEP MATHUR Order 03/02/2025 1. These applications for bail under Section 483 BNSS have been filed by the petitioners who have been arrested in connection with F. I. R. No.

349/2024 registered at Police Station Gogunda, District Udaipur for offences under Sections 310(2), 127(1), 115(2) & 61 of BNS. 2. As per the prosecution, on 14. 10. 2024, petitioners at about 06:30 AM wrongfully restrained the complainant and started beating him. The petitioners had also snatched a sum of Rs. 43,420/- from him and also got Rs. 10,000/- transferred from his phone to the bank account in the name of one Ratan Giri. 3. Learned counsel for the petitioners submitted that the petitioners have been falsely implicated in the present case. Learned counsel further submitted that the petitioners are in judicial custody; the investigation against the present petitioners has already been completed and the trial of the case will take sufficiently long time, therefore, the benefit of bail may be granted to the accused-petitioners. 4. Per Contra, learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail application.

[2025:RJ-JD:6509] (3 of 4) [CRLMB-894/2025] Learned counsel for the complainant has submitted that in the present case, the recovery of Rs. 43,420/- is still due to be made from the present petitioners. Learned counsel further submitted that looking to the seriousness of the allegations levelled against the present petitioners, they do not deserve to be enlarged on bail. However, they were not in position to refute the fact that the investigation against the present petitioners have already been completed and the challan against them has already been filed before the competent Criminal Court. They were also not in a position to refute the fact that the injuries allegedly inflicted upon the complainant by the present petitioners are simple in nature. 5. Heard learned counsel for the petitioners and learned Public Prosecutor and learned counsel for the complainant. Perused the material available on record. 6.

Having considered the rival submissions, facts and circumstances of the case, this Court is of the opinion that the bail applications filed by the petitioners deserve to be accepted. 7. Consequently, these bail applications under Section 483 of BNSS are allowed. It is ordered that the accused-petitioners (1) Dhanna Lal @ Dharmesh S/o Dalla Ram (2) Vishnu S/o Sawa Ram (3) Ratangiri S/o Maangiri (4) Kailash Chandra S/o Daulatram (5) Devilal S/o Rodilal and (6)Kishan Singh S/o Mohansingh arrested in connection with F.
