By filing this petition under Section 438 of the CrPC, petitioner Sandan Boro has sought for pre-arrest bail in connection with Mangaldai P. S. Case No. 836/2019, under Section 457/380 of the IPC. Heard learned counsel for both sides and perused the record and the case diary. The allegation as regards the commission of theft of Rs. 21,00,992/- from the locker of the Instakart Service Pvt. Ltd. , on 08. 02. 2019.
The FIR was filed by the authorized signatory of the said Company, about such commission of theft and subsequently three accused persons were arrested in connection with the case and in their statement, the arrested accused persons have revealed that along with the Page No. # 2/2 present accused/petitioner, named above, conjointly committed the offence and shared the stolen amount amongst themselves. In view of such gravity of the offence and complicity of the accused person, this is not a fit case to grant the privilege of pre-arrest bail. Accordingly the bail petition stands dismissed.
