IN THE HIGH COURT OF ORISSA AT CUTTACK WPCRL No. 148 of 2025 Tapan Mandal …. Petitioner Represented by Adv. – Mr. Manas Kumar Chand, Advocate -Versus- State of Odisha and others …. Opposite Parties Represented by Adv. – Ms. Suman Pattanayak, A. G. A. for State CORAM: HON’ BLE THE CHIEF JUSTICE AND HON’BLE MR. JUSTICE MURAHARI SRI RAMAN ORDER Order No. 23. 12. 2025 04. 1. After great persuasion and the directions passed from time to time, the minor victim girl has been rescued by the Police team. Astonishingly, the members of the raiding team were electrocuted so as to avoid the recovery of the minor girl for which the action is required to be taken as permissible in law. 2. After rescue of the minor victim girl, she was taken to a hospital where she refused to undergo the medical examination. The disclosure of the statement under Section 183 of the BNSS establishes the prima facie case of commission of an offence under the several provisions of the BNSS and the POCSO Act.
The accused has been apprehended and the victim was produced before the CWC, Kendrapara. After necessary counseling having conducted by the CWC, she has been integrated into the family and is living there. 3. Since the girl has already been rescued, there is no purpose of her physical production before this Court. 4. The writ petition is, thus, dismissed. (Harish Tandon) Chief Justice (M. S.
