Neutral Citation No. - 2024:AHC-LKO:82297 Court No. - 8 Case :- WRIT - C No. - 10606 of 2024 Petitioner :- Prem Kumar And 4 Others Respondent :- Board Of Revenue U. P. , Lucknow Thru. Chairman And Another Counsel for Petitioner :- Raj Karan Singh Counsel for Respondent :- C. S. C. Hon'ble Jaspreet Singh,J. 1. Heard learned counsel for the petitioners. Notice on behalf of respondent No. 1 has been accepted by the office of Chief Standing Counsel. 2. The grievance of the petitioners is that a revision has been filed before the Board of Revenue, wherein after hearing the petitioners, the revision was admitted and an interim order was granted vide order dated 13. 03. 2024, a copy of which has been brought on record as Annexure No. 11 to the writ petition. It is urged that on the next date, i. e. , 02. 05. 2024, the petitioner had moved an application seeking extension of the interim order. However, the same has not been considered and while passing the order on 02. 05.

2024, the interim order was not extended. However, even on the next date, i. e. , 01. 07. 2024, a similar application was moved even that has not been considered and in such circumstances, the petitioners pray that a direction be issued to respondent No. 1 to extend the interim order dated 13. 03. 2024. 3. Having considered the aforesaid submissions and from perusal of the material on record, learned counsel for the petitioners could not point out any particular application, which has been moved by the petitioner indicating that the interim order, which was granted on 13. 03. 2024, was not extended despite having moved an application, which has not been taken note of. The applications which have been pointed out by learned counsel for the petitioners are simpliciter applications seeking extension of the interim order without disclosing that on the last date, the interim order was not extended.

In case, if it is the case of the petitioner that he had moved a specific application, but no order has yet been passed and the same has not been considered, it will be appropriate for the petitioner to move before the same court raising his grievances. In the aforesaid circumstances, this Court grants liberty to the petitioners to move a substantive application before the court concerned, who needless to say after affording an opportunity of hearing to the parties, shall pass an appropriate order. With the aforesaid, the writ petition is disposed of. Order Date :- 10. 12. 2024 Ashutosh Digitally signed by :- ASHUTOSH PANDEY High Court of Judicature at Allahabad, Lucknow Bench
