Serial No. 04 Suppl. List HIGH COURT OF MEGHALAYA AT SHILLONG WP (C) No. 426 of 2020 Date of Order: 15. 12. 2020 _____________________________________________________________ Shri. Amzad Khan Vs. State of Meghalaya & 5 Ors. Coram: Hon’ble Mr. Justice Ranjit More, Judge Appearance: For the Petitioner/Appellant(s) : Mr. S. Dey, Adv. For the Respondent(s) : Mr. B. Bhattacharjee, AAG. with Ms. R. Colney, GA. It is the case of the petitioner that because of his unauthorized absence Departmental Enquiry was initiated against him and an ex parte order is passed and thereby his services are terminated. The petitioner as against the order of termination of his service had filed appeal before the respondent No. 5 (The Inspector General of Police (IGP), (Trg & Armed Police), Meghalaya Police, Government of Meghalaya Shillong) in the month of July, 2020. Mr. S. Dey, learned counsel for the petitioner makes a grievance that this appeal is not so far disposed of by the respondent No. 5. Mr. B.

Bhattacharjee, learned AAG submits that appropriate directions may be issued to the respondent No. 5. In above circumstances, I dispose of this petition by directing respondent No. 5 to dispose of petitioner’s appeal, copy of which is annexed at Page-54 (Annexure-13) as expeditiously as possible and preferably within the period of 3 (three) months from the date of the receipt of this order. Ordered accordingly. It is made clear that I have not gone into the merits of the matter and respondent No. 5 shall decide the said appeal of the of the petitioner independently on its own merit and in accordance with law. Needless to mention that in the event any order passed by respondent No. 5 adverse to the interest of the petitioner, he is at liberty to approach this Court.
