Also heard Mr. Kohinoor N. Bhattacharyya, learned G. A.
appearing for the State-respondents. The petitioner is a differently-abled person. She has been serving the State-respondents as Multi Purpose Worker. The petitioner has alleged in the writ petition that the respondents have taken up the process of promotion to the next higher post. It is her further case that 4% posts are reserved for differently-abled persons having the benchmark disability. So, she wants promotion against the vacant promotional post. Mr. Bhattacharyya, learned G. A. appearing for the State-respondents has submitted that promotion is not a matter of right, but, it is a right to be considered. Whenever, the respondents will exercise the process of promotion to the next higher post, the case of the petitioner shall definitely be considered if he is otherwise eligible. In view of the above submission of learned G. A.
, I left the matter to the Government to consider the issue of promotion of the petitioner to the next higher post as and when such process of promotion will be taken up. The State-respondents shall keep in mind that 4% posts are reserved for persons with benchmark physical disability. With the aforesaid observations and directions, the instant writ petition stands disposed. JUDGE Digitally signed by SANJAY GHOSH SANJAY GHOSH Date: 2024. 11. 29 11:06:41 +05'30' sanjay
