Weekly List Serial No. 01 IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU Bail App No. 38/2025 CrlM No. 249/2025 Date of pronouncement : 06. 03. 2026 Uploaded on : 06. 03. 2026 Rakesh Sharma @ Bunty Sharma …. Petitioner Through:- Mr. Rupak Ratta, Advocate Mr. Ashfaq Ahmed Khan, Advocate. V/s UT of J&K & Anr. ….. Respondents Through:- Mr. Bhanu Jasrotia, GA for R-1. \ CORAM: HON’BLE MR. JUSTICE SANJAY DHAR, JUDGE ORDER (ORAL) 01. The victim has also not put in her appearance today nor has she filed her reply to the bail application. However, reply on behalf of respondent No. 1 stands already filed. 02. The petitioner has been granted interim anticipatory bail by this Court vide order dated 19. 02. 2025. During pendency of this bail application, it seems that charge-sheet against the petitioner stands already filed which has been challenged by the petitioner by way of a petition under Section 528 BNSS bearing CRM(M) No. 565/2025.
Learned counsel for the petitioner has produced a copy of order dated 04. 07. 2025 passed in the said petition, whereby proceedings before the trial court have been stayed. 03. There is nothing on record to show that the petitioner, during the pendency of this bail application, has misused the concession of interim bail or that he has violated any condition of the bail. 04. Since the Challan stands already filed against the petitioner and proceedings in the Challan have been stayed, therefore, the interim anticipatory bail granted to the petitioner on 19. 02. 2025 is made absolute, subject to the conditions contained in the said order. 05. Disposed of along with connected application(s), if any. (SANJAY DHAR) JUDGE JAMMU 06. 03. 2026 Bunty Whether the order is speaking: Yes/No Whether the order is reportable: Yes/No Bunty Kumar 2026. 02. 12 10:29 I attest to the accuracy and integrity of this document
