No. 286 Lane No. 3, Adarsh Enclave, Trikuta Nagar, Tehsil Bahu, District Jammu. Through :- Mr. M. K. Bhardwaj, Sr. Advocate with Mr. Aditya Sharma, Advocate. V/s 1. UT of J&K through Commissioner-cum- …. Respondent(s) Secretary, Finance Department, Civil Secretariat, Jammu, 180001. 2. Excise Commissioner, Jammu. 3. Deputy Excise Commissioner, Jammu. 4. Technical Programmer/Officer, Excise Department, Jammu. Through :- Mr. K. D. S. Kotwal, Dy. AG. Coram: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE ORDER 21. 02. 2024. 1. The short grievance projected by the petitioner in this petition is that in response to notice No. EC/Exc/e-auction/2024-25/7182, he, who was intending to participate in the e-auction, tried to submit his bid but could not do so due to some technical glitch in the process.
He could not click “CLICK HERE TO BID” option as the same was not available in the system. He immediately informed the Excise Commissioner through WhatsAapp messages and also by sending e-mail. WP(C) No. 328/2024 2. The petitioner claims that he even showed the glitch in the system through a video call to the Excise Commissioner. 3. Learned counsel for the petitioner submits that respondent No. 2 has not attended to his grievance and is proceeding ahead with the finalization of the e-auction process. 4. Having heard learned counsel for the parties and regard being held to the nature of the grievance projected, this petition is disposed of at this stage by directing the Excise Commissioner to attend the grievance of the petitioner, claimed to have been projected by the petitioner through WhatsApp messages, video call and e-mail which are part of record of this petition and take an appropriate decision thereon before finalizing the e-auction process for the vend in question. 5.
Needless to say that in case the Excise Commissioner finds that the petitioner was prevented from participating in the e-bid due to technical glitch beyond the control of the petitioner and attributable to the respondent No. 2, appropriate decision to accommodate the petitioner by issuing fresh notice shall be taken.
