By filing this petition under Section 439 of the CrPC, petitioner Aminul Islam, who is in custody since 06. 01. 2020, has prayed for releasing him on bail in connection with North Guwahati P. S. Case No. 57/2018, under Section 379 of the IPC. Heard the learned counsel for the parties and perused the case record. The allegation is about the theft of a pregnant goat of the informant by the Maruti Alto KT (0176) Uber Vehicle, vide FIR dated 05. 06. 2018.
Peculiarly the present accused was arrested on 06. 01. 2020, without there being any mention as to whether the goat was recovered from him or not and his Page No. # 2/2 vehicle number not tally with the vehicle seized. Considering the above and the length of detention, it can be presumed that further detention of the accused is not necessary. Accordingly the accused person named above is allowed to go on bail of Rs. 20,000/- with one surety of like amount, to the satisfaction of the learned CJM, Kamrup at Amingaon, in connection with the North Guwahati P.
