Ghosh, Addl. PP HON’BLE MR. JUSTICE ARINDAM LODH Order 05/08/2024 Heard Mr. S. Lodh, learned counsel appearing for the applicant. Also heard Mr. S. Ghosh, learned Additional PP appearing for the respondent-State. It appears that in terms of the earlier orders passed by this court, both the applicant and his father have failed to deposit the required amount to the bank account of the complainant as per their undertaking before this court. In this circumstance, Mr. Lodh, learned counsel appearing for the applicant submits that this court may pass necessary order. I have perused the case record. It appears that this court had given ample opportunities to the applicant to refund the balance amount of Rs. 12 lakh to the person concerned. However, it has not been materialized.
Moreso, refund of money cannot otherwise help the accused-applicant to be released on bail. In view of this, interim bail as was granted to the accused-applicant, namely, Debashis Dey vide order dated 28. 03. 2024 is recalled, and therefore, vacated. The accused-applicant shall surrender before the Investigating Officer of RK Pur Police Station, Gomati District, by 10. 30 a. m. tomorrow i. e. on 06. 08. 2024 failing which the Investigating Officer shall ensure all necessary measures to arrest the accused-applicant, Debashis Dey.
