L. B. DABHI, APP for the Respondent(s) No. 1 ========================================================== CORAM: HONOURABLE DR. JUSTICE ASHOKKUMAR C. JOSHI Date : 16/12/2020 ORAL ORDER 1. Heard learned APP Mr. L. B. Dabhi for the Respondent State through the video conference. 2. Rule. Learned APP waives service of notice of rule for the Respondent State of Gujarat. 3. The petitioner has filed this petition through jail for grant of parole leave of 20 days on the ground of paying amount of penalty. He has therefore requested to grant him parole leave on humanitarian ground. 4.

Learned APP has submitted that the opinion of I. G. Prison is negative and report shows that jail conduct is not good. Further the petitioner was absconded for 1059 days earlier. There is no genuine ground and justifiable reason to entertain the present petition . 5. Hence, in view of the submission made by the learned APP R/SCR. A/8334/2020 ORDER and the ground mentioned in the petition as well as jail remarks, it transpires that the petitioner earlier granted parole leave at that time, the petitioner remained absconded for 1059 days and jail remarks is also not good. Therefore, no case is made out to release the petitioner on parole leave. Hence, petition is rejected. Rule is discharged. (DR. ASHOKKUMAR C. JOSHI,J) prk
