Tirupati Chandra For Respondent(s) : Mr. Hanuman Prajapati, PP HON'BLE MR. JUSTICE BALJINDER SINGH SANDHU Order 05/08/2026 This application for bail under Section 483 BNSS (439 Cr. P. C. ) has been filed by the petitioners who has been arrested in connection with F. I. R. No. 242/2024 registered at Police Station Kotwali, District Sirohi, for offences under Sections 420, 406 and 120-B of IPC. Learned counsel for the petitioners submitted that the offences alleged to have been committed by the petitioners are [2026:RJ-JP:36974] (2 of 3) [CRLMB-8916/2026] triable by court of Magistrate. The allegations levelled against the petitioners are that they took a gold loan against the fake jewellery. He states that investigation from them is complete and charge-sheet has already been filed and no recovery remaining to be affected from them. Learned counsel submitted that the petitioners is in judicial custody since 22. 05.
2026 and the trial of the case will take sufficiently long time, therefore, the benefit of bail may be granted to the accused-petitioners. Per contra, learned Public Prosecutor has opposed the bail application. This Court has considered the rival submissions and perused the material available on record. The offences alleged to have been committed by the petitioners are triable by court of Magistrate. The investigation from them is complete and charge-sheet has already been filed and no recovery remianing to be affected from them. The petitioners is in judicial custody since 22. 05.
2026 Hence, keeping in view the facts and circumstances of the case; the alleged offences are triable by a Magistrate; and that conclusion of the trial of the case is likely to take time and the prosecution has not shown any apprehension of the petitioners fleeing away from justice, in case he is enlarged on bail; but, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the petitioners under Section 483 of BNSS. Consequently, the bail application under Section 483 BNSS (439 Cr. P. C. ) is allowed. It is ordered that the accused-petitioners [2026:RJ-JP:36974] (3 of 3) [CRLMB-8916/2026] Sheikh Amber S/o Gulam, Somnath S/o Archita and Noor Mohammad S/o Zeharli arrested in connection with FIR No. 242/2024 registered at Police Station Kotwali, District Sirohi, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs. 50,000/- and two sureties of Rs.
