Neutral Citation No. - 2024:AHC-LKO:86427 Court No. - 19 Case :- WRIT - C No. - 11250 of 2024 Petitioner :- Saad Mohd Aslam Advocate Respondent :- Bar Council Of New Delhi Thru Its Chairman /Secy. And Ors. Counsel for Petitioner :- In Person Counsel for Respondent :- Nalin Raj Cahturvedi,Raj Kumar Upadhyaya (R. K. Upadhyaya) Hon'ble Manish Mathur,J. Heard petitioner in person and learned counsel for opposite parties. Present petition has been filed seeking a direction to the opposite parties to reschedule one of the examinations pertaining to the All India Bar Examination scheduled to be held on 22. 12. 2024. Petitioner in person submits that he has been registered with the Bar Council in the year 2023 and is required to clear the aforesaid examination within two years from the date of registration.
It is submitted that in case the examination is not rescheduled, it would be difficult for him to clear the aforesaid examination within a period of two years as prescribed since examinations are held only after one year. Although the examination is required to be held biannualy. Learned counsel for the opposite parties have refuted the submissions advanced by the learned counsel for the petitioner with the submission that the petition, in fact, is premature since petitioner still has time available up to year 2025 to clear the aforesaid examinations. It is submitted that the said examination are held biannually and will be held again after six months which will be very well within the period of two years required by the petitioner to clear the aforesaid examination. In view of the aforesaid facts and circumstances and submissions it is evident that the petitioner still has ample time left to clear the aforesaid examinations.
Even otherwise a writ in the nature of Mandamus has been sought without indicating any statutory duty upon the opposite parties for rescheduling the aforesaid examination. Considering the aforesaid facts this Court does not find any occasion to intervene the petition, therefore, is dismissed.
