Sinha, learned counsel for the petitioner and Mr. Shekhar Sinha, learned P. P. for the State. The petitioner has prayed for grant of anticipatory bail, as he is apprehending his arrest in connection with Barkatha P. S. Case No. 198 of 2018. It has been alleged that coal was found being unloaded near a brick kiln. The petitioner used to purchase illegally extracted coal for running the brick kiln. The implication of the petitioner appears to be only on the basis of suspicion. The petitioner has got no criminal antecedent as stated in this application.
On consideration of the aforesaid facts, the petitioner is directed to surrender before the learned court below within a period of four weeks and on his surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate st 1 Class, Hazaribagh in connection with Barkatha P. S. Case No. 198 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands allowed. (R. Mukhopadhyay, J. ) Alok/-
