IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWPOA No. 5766 of 2019 Date of decision: 11. 11. 2020 Roop Lal …. Petitioner Versus State of Himachal Pradesh & Ors. …. Respondents Coram The Hon’ble Mr. Justice Sandeep Sharma, J. 1 Whether approved for reporting ? ___________________________________________________ For the Petitioner: Mr. Sandeep Chauhan, Advocate. For the Respondents: Mr. Sudhir Bhatnagar and Mr. Arvind Sharma, Additional Advocate Generals with Mr. Kunal Thakur, Deputy Advocate General. Sandeep Sharma, Judge(Oral): (Through Video Conferencing) Learned counsel representing the petitioner, on instructions, states that petitioner would be content and satisfied, in case, he is permitted to file fresh representation with the direction to the respondents to decide the aforesaid representation, within the stipulated time. 2. Mr.
Kunal Thakur, learned Deputy Advocate General while referring the reply filed on behalf of the respondents, contends that prayer made on behalf of the petitioner for appointment on compassionate ground was considered and rejected by the authority, but fresh representation, if any, shall be decided by the authority concerned in terms of the policy in vogue. 1 Whether the reporters of Local Papers may be allowed to see the judgement? 3. Consequently, in view of the above, present petition is disposed of reserving liberty to the petitioner to file fresh representation, seeking therein his appointment on compassionate grounds, on account of death of his father, within a period of four weeks, with further direction to the respondents to decide the same expeditiously, preferably within a period of six weeks, thereafter. 4.
Needless to say that authority concerned while considering the fresh representation made on behalf of the petitioner, shall afford him opportunity of being heard and pass a speaking order. Pending application(s), if any, also stand disposed of. (Sandeep Sharma) Judge th 11 November, 2020 (reena)
