IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr. Revision No. 523 of 2020 Deepak Kumar Yadav …… Petitioner Versus The State of Jharkhand ….. Opp. Party --------- CORAM: HON'BLE MR. JUSTICE AMITAV K. GUPTA --------- For the Petitioner : Mr. A. K. Chaturvedi, Advocate For the State : Mrs. Vandana Bharti, A. P. P ---------th 05/Dated: 15 December, 2020 1. This revision is direction against the order dated 10. 06. 2020, passed by the court of learned Additional Sessions Judge – I, Latehar, in Criminal Appeal No. 09 of 2020, whereby the prayer for bail of the petitioner has been rejected, in connection with Manika P. S. Case No. 47 of 2019, corresponding to Special POCSO Case No. 35 of 2019, registered under Section 376 of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences Act. 2. Heard learned counsel for the petitioner and learned A. P. P.
On perusal of the materials on record, it appears that the Social Investigation report is not in favour of the petitioner. Moreover, the victim, aged 14 years, in her statement, recorded under Section 164 Cr. P. C. , has stated that the petitioner had entered into the house and committed rape on her and when her elder sister came he ran away. The witnesses have stated that they had seen the petitioner fleeing from the place of occurrence. Considering the materials on record, at this stage, I am not inclined to enlarge the petitioner on bail. 3. The court below is directed to expedite the enquiry and conclude it preferably within six months from the date of receipt/ production of this order, failing which the petitioner is at liberty to renew his prayer for bail. 4. In the result, the revision is, hereby, dismissed. (AMITAV K. GUPTA, J. ) Chandan/-
