PATTANAIK ORDER Order 08. 04. 2026 No. 01. 1. Both the ABLAPLs are taken up together for common order. 2. Heard learned counsel for the respective parties. 3. Instant petitions under Section 482 BNSS are filed seeking pre-arrest bail of the petitioners in connection with C. T. Case No. 712 of 2025 pending in the file of learned S. D. J. M. , Athagarh arising out of Athagarh P. S. Case No. 335 of 2025 on the grounds stated. 4. Perused the FIR as at Annexure-1. A case under Section 109 BNSS is registered with the other allied offences alleged against the petitioners. It is submitted to the Court that the co-accused persons are on bail.
The copies of the bail orders with respect to the co-accused persons are produced. The submission is that the co-accused, namely, Aspak Ali and Juma Khan, who allegedly committed the mischief have been allowed to go on th bail vide BLAPL No. 12952 of 2025 dated 18 December, 2025, a copy of which is produced in Court today. The other bail order in the ABLAPL is at Flag-A. The allegation is about the illicit transportation of cattle, hence, the FIR. Recorded the objection of the State. The petitioners said to have other antecedents of similar nature. But having regard to the release of the co-accused persons and under the impression that substantial part of the investigation, this Court, though not in favour of entertaining any such plea for pre-arrest bail, is inclined to direct the petitioners to surrender before the learned court below for being released with stringent conditions. 5.
