Learned AGA submits that the operative portion of the order is agreeably as clear as Gangetic water and that part of the order has already been complied with so far as terminal benefits minus gratuity is concerned. However, this is disputed by learned counsel for the Complainant. He very fairly submits that if a period of two weeks is granted, compliance of the entire order would be reported. Very reluctantly the said submission is accepted and proceedings are dropped with stipulation that in the event the order is not complied with, the OP No. 1, namely, Dr. N.
Thirumala Naik, Commissioner-cum-Secretary, School & Mass Education Department, Bhubaneswar would pay to the Complainant Rs. 1,00,000/- (Rupees One Lakh only) in a lump sum and also Rs. 1000/- per day of delay in compliance. Ordered accordingly and CONTC is dropped with liberty to the Complainant to seek its revival by moving appropriate application for taking aggravated contempt action.
