JUSTICE RUMI KUMARI PHUKAN ORDER Date : 25-09-2020 Heard the learned counsel appearing for both the parties. By this Interlocutory Application the applicants have prayed for correction of an error in the order dated 31. 08. 2020 passed in A. B. No. 2097/2020. Learned counsel for the applicants submits that while drafting the Anticipatory Bail Application No. 2097/2020 there was some inadvertent error in typing the Police Station number and the Police Station number was wrongly typed as P. S. Case No. 466 of 2017 instead of P. S. Case No. 406 of 2017.
Consequently, the same has also been reflected in the order dated 31. 08. 2020 by which the interim anticipatory bail was granted to the applicants/petitioners. Accordingly, learned counsel for the petitioner prays for correction of the order dated 31. 08. 2020 and also prays for leave of this Court for correction of the Police Station number in the Anticipatory Bail Application. Further, learned counsel for the applicants prays for extension of the period of time granted by this Court for appearance of the applicants/petitioners before the Investigating Officer since the petitioners could not appear before the Investigating Officer due to the reason stated above. Perused the Anticipatory Bail Application No. 2097/2020 as well as the order dated 31. 08. 2020. Learned Additional Public Prosecutor has no objection to the prayers so made by the learned counsel for the applicants. Accordingly, it is directed that “P. S. Case No. 466/2017” wherever appearing in the order dated 31. 08.
2020, stand corrected and the same shall be read as “P. S. Case No. 406/2017”. Leave is also granted for correction of the police station case number in the Page No. # 4/4 Anticipatory Bail Application No. 2097/2020 as mentioned above. Further, the applicants/petitioners are allowed further 15 (fifteen) days’ time from today to appear before the Investigating Officer in terms of the order dated 31. 08. 2020. Interlocutory Application stands disposed of in terms of the above. This order shall form a part of the order dated 31. 08. 2020 passed in Anticipatory Bail Application No. 2097/2020.
