The petitioner had purchased a vehicle bearing Reg. No. KL 34H 6806 by availing financial th assistance from the 5 respondent. The petitioner has th made substantial payments to the 5 respondent. The th 5 respondent has filed a pre-litigation petition before rd the 3 respondent, who has issued Ext.
P3 notice to the rd petitioner to appear before the 3 respondent. However, on the said day when the petitioner appeared, th the sitting was cancelled. The 5 respondent is taking hasty steps to re-possess the petitioner's vehicle . The th action of the 5 respondent is illegal and arbitrary Hence, the writ petition. 2025:KER:31469 W. Heard; the learned counsel for the petitioner, the learned Government Pleader, the learned rd counsel for the 3 respondent and the learned counsel for the respondents 4 and 5. 5. The learned counsel appearing for the rd 3 respondent submitted that, even though a notice was issued to the petitioner to appear for pre-litigation settlement talks, the petitioner did not appear before rd rd the 3 respondent. Consequently, the 3 respondent has closed the pre-litigation petition. The learned counsel appearing for respondents 4 and 5 submitted that, they would re-possess the petitioner's vehicle only in accordance with law.
