Item No. 91-93 IN THE HIGH COURT OF MANIPUR AT IMPHAL MC(WP(C) No. 78 of 2024 with MC(WP(C) No. 35 of 2024 with WP(C) No. 58 of 2024 Imphal Municipal Corporation ….. Petitioner/s - Versus – Moirangthem Kunjaraj Singh & 6 Ors. .... Respondent/s BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA Order 02. 09. 2024 [1] Present Mr. Ajoy Pebam, learned counsel for the petitioner, Mr. Th. Sukumar, learned G. A. for the State respondent and Mr. Y. Nirmolchand, learned senior counsel assisted by Mr. L. Raju, learned counsel on behalf of Imphal Municipal Corporation. None appeared on behalf of respondent No. 4 in spite of service of summons. [2] The petitioner approached this Court challenging the impugned letter dated 18. 12. 2023 for accommodating respondent No.

4 to the post of Assistant Revenue Inspector in Imphal Municipal Corporation and with a prayer for mandamus directing the respondent to appoint the petitioner who is working as Field Assistant to the next higher post of Assistant Revenue Inspector. Vide order dated 25. 01. 2024, this Court stayed the proposal made in the impugned letter Page 1 dated 18. 12. 2023 till the next date and the interim order is extended from time to time. [3] During the course of hearing, Mr. Y. Nirmolchand, learned senior counsel for the Imphal Municipal Corporation, submits that there are more vacancies for promotion to the post of Assistant Revenue Inspector and the case of the petitioner is already under consideration and the impugned proposal dated 18. 12. 2023 of accommodating private respondent No. 4 in the cadre of Assistant Revenue Inspector will not affect the promotional avenue of the petitioner.

The proposal for promotion of the petitioner and other eligible candidates to the post of Assistant Revenue Inspector has already been undertaken vide order dated 03. 10. 2023 and the same could not be finalized due to the interim order passed by this Court. [4] After perusing the materials on record and hearing the submissions made at the bar, this Court is of the opinion that the writ petition can be disposed of by directing the official respondent to expedite the process of promotion of the petitioner and other eligible candidates within a stipulated period of time preferable within a period of 3 (three) months from the date of receipt of a copy of this order. [5] With this observation, writ petition is disposed of. [6] Interim order dated 25. 01. 2024 is vacated and any pending application is disposed of. JUDGE Kh. Joshua Maring Digitally signed by KH.
