Item No. 1 (Through video conferencing) IN THE HIGH COURT OF MANIPUR AT IMPHAL Bail Appln. No. 13 of 2020 N. Chandrama Devi …. Applicant/s - Versus – Officer in Charge Nambol Police Station .... Respondent/s BEFORE HON’BLE MR. JUSTICE AHANTHEM BIMOL SINGH 11. 12. 2020 Heard Mr. N. Ibotombi, learned senior counsel appearing for the petitioner and Mr. Y. Ashang, learned Public Prosecutor (PP) appearing for the respondent. [2] The present application has been filed by the petitioner for releasing her son namely Mr. N. Romesh Singh on bail. Mr. N. Ibotombi submitted that the accused person had been arrested in connection with FIR No. 57(9)2020 NBL-PS Under Section 302/34 IPC. The learned senior counsel further submitted that the earlier bail application filed before the Court of Sessions Judge, Bishnupur had been rejected only on the ground that the relevant documents for treatment of the accused namely Mr. N.
Romesh Singh in JNIMS, who is suffering from Uteric Calculi(stone case), were not enclosed and on that ground alone, the earlier bail application had been rejected. Drawing the attention of this Court to the letter dated 26. 11. 2020 from the Superintendent, Manipur Central Jail, Sajiwa addressed to the learned PP, High Court, wherein the medical report of the Central Jail, Sajiwa, Imphal had been enclosed, it is pointed out by the learned senior counsel that Bail. Appln. No. 13 of 2020 Page 1 in the said medical report, it is clearly stated that the accused is suffering from Stone Case and was produced at JNIMS Hospital on 15. 11. 2020 and diagnosed as a case of right Uteric stone(12 mm) which has resulted in swollen kidney. It is further pointed out by the learned senior counsel that the Medical Officer had clearly pointed out that the condition of the accused will deteriorate if his illness is not treated urgently and right kidney failure is possible if left untreated.
In the said report, it is also mentioned that the said accused must be treated at a well established hospital outside the Jail as Central Jail, Sajiwa is not suitable for the treatment of such illness. In view of the above, learned senior counsel prayed that the said accused Shri Romesh be enlarged on bail so as to enable him to get treatment for his ailments. [3] Mr. Y. Ashang, learned PP fairly contended that the status of the suffering of the petitioner as mentioned in the medical report is correct and he would have no objection if the said accused is released on bail for a limited period so as to enable the said accused person to get treatment to a well equip hospital outside the Jail. [4] The learned PP further submitted that the said accused person can be enlarged on bail for a period of 4(four) months to get his treatment and after availing such treatment, the said accused person must report back to the concerned jail authorities in connection with the said FIR case.
[5] After hearing both the counsel appearing in this case, it is directed that the accused person should be enlarged on bail for a period of Bail. Appln. No. 13 of 2020 Page 2 4(four) months from today so as to enable him to get treatment of his ailments outside the Central Jail on the following terms and conditions: (i) The accused person should submit a bail bond of Rs. 20,000/-(twenty thousand) with one surety for the said amount and (ii) After availing his treatment, the accused person must report back to the concerned authorities of Manipur Central Jail, Sajiwa on expiry of 4(four) months from today. With the above directions, this bail application is disposed of. st A true copy of this order be furnished to the Judicial Magistrate 1 Class, Bishnupur and both the counsel appearing for the parties for doing the needful.
