Sr. No. 51 Suppl. List. 1 IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR LPA No. 32/2024 Aaqib Hussain & Ors. …Petitioner(s)/Appellant(s) Through: Mr. M. I. Qadiri, Sr. Adv. with Mr. Owais Shafi, Adv. Vs. University of Kashmir & Ors. ... Respondent(s) Through: Mr Asif Maqbool, Dy. AG CORAM: HON’BLE MR. JUSTICE ATUL SREEDHARAN, JUDGE HON’BLE MS. JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE O R D E R 21. 02. 2024 th Pursuant to the order dated 19 February 2024, this Court had a meeting with the Chief Engineer of the PW(R&B) Department, Mr. Sajad Ahmad Naqeeb. In the course of meeting, it was revealed that the reason why there was a total black-out in the High Court premises was on account of the abrupt break-down of 250 KVA generator due to overloading as the other generator 320 KVA was still undergoing maintenance for almost two months.
We express our concern that the period of maintenance was excessively long and that responsibility must be affixed within the organization as to why a vital equipment that was necessary to supply power to the High Court during the power-cut was under maintenance for two long months. Mr. Sajad Ahmad Naqeeb, Chief Engineer, has also assured us that he will look into the matter and also ensure that the High Court shall never have power cuts of this duration ever again and that if need be, the Department would hire a 320 KVA generator as a standby to ensure seamless power during power-cuts to the High Court. In view of the assurance given by Mr. Sajad Ahmad Naqeeb, Chief Engineer, we are satisfied that no further action needs to be taken in this case. The issue can be given a quietus. Mr. Sajad Ahmad Naqeeb, has also suggested that a power audit of the High Court be carried out by the Kashmir Power Development Corporation Limited (KPDCL).
In that regard, we have already instructed Registrar Judicial of this Court to address the issue by sending a letter to the Power Generation Company forthwith and ensure that the power audit of the High Court premises is done and that the total requirement of the High Court is calculated and the same be communicated to the PWD to ensure such less incidents does not happen in future. th The issue raised by the previous order dated 19 February 2024 stands closed. LPA No. 32/2024 In terms of order dated 07. 02. 2024 passed by a Co-ordinate Bench of this Court in LPA No. 21/2024 by which a separate LPA filed by one Saba Mansoor Ganai & Ors. who were co-petitioners in the same petition as that of the appellants herein which is WP (C) No. 169/2024 was disposed of in terms of paragraph No. 6 of that order. Under the circumstances, the instant appeal is also disposed of in terms of paragraph No. 6 of the order dated 07. 02. 2024 passed by a Co-ordinate Bench of this Court in LPA No. 21/2024.
