Neutral Citation No. ( 2026:JHHC:13491 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr. Rev. No. 347 of 2026 Khurshid Ansari, son of Farukh Ansari, represented through his father and natural guardian Farukh Ansari, son of Nasruddin Miyan, resident of Village: Bariyarpur, PO: Shitalpur, PS: Karmatar, District: Jamtara (Jharkhand). ... Petitioner Versus The State of Jharkhand … Opposite Party --- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY For the Petitioner : Mr. Arvind Kumar Choudhary, Advocate; Mr. Prathik, Advocate For the State : None --- 02/06. 05. 2026 Heard Mr. Arvind Kumar Choudhary, learned counsel for the petitioner. None appears on behalf of the State. This application is directed against the order dated 17. 01. 2026, passed by the learned Additional Sessions Judge-I, Jamtara in Criminal (Juvenile Bail) Appeal No. 23/2025, whereby and whereunder, the order dated 01. 12.

2025, passed by the learned Principal Magistrate, Juvenile Justice Board, Jamtara in connection with Karmatar P. S. Case No. 56/2025 rejecting the prayer for bail of the petitioner has been affirmed. It has been alleged that when the informant had gone to the village of her uncle, she had an acquittance with the petitioner and it is said that on 31. 03. 2025 in the midnight the petitioner had entered into the room of the informant and established physical relationship with her. It has further been alleged that on the threat of making the video viral, the petitioner had continued to establish physical relationship with her and when the marriage of the informant was settled, the petitioner had caused impediment in the said marriage by threatening to send the video to her prospective husband. Submission has been advanced by the learned counsel for the petitioner that there has been a delay of 2 ½ months in institution of the First Information Report.

It has further been submitted that it is indeed surprising that the petitioner had entered into the room of the informant and established physical relationship with her but despite the said fact the informant had not raised any hue and cry and the petitioner continued to establish physical relationship with the informant without any resistance. Learned counsel submits that the same would indicate that there was a love affair between the petitioner and the informant, who is the major girl, aged about 19 years. Learned counsel adds that the petitioner is in observation home since 05. 09. 2025.

On consideration of the allegations made, there seems to be an iota of truth with respect to the submissions advanced by the learned counsel for the petitioner regarding a consensual sexual relationship between the petitioner and the informant, who is a major and considering the fact that there is an inordinate and unexplainable delay of 2 ½ months in institution of the First Information Report, this Court while setting aside the order dated 17. 01. 2026, passed by the learned Additional Sessions Judge-I, Jamtara in Criminal (Juvenile Bail) Appeal No. 23/2025 and the order dated 01. 12. 2025, passed by the learned Principal Magistrate, Juvenile Justice Board, Jamtara in connection with Karmatar P. S. Case No. 56/2025, direct that the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Juvenile Justice Board, Jamtara in connection with Karmatar P. S. Case No.

56/2025, subject to the conditions that one of the bailors should be the father of the petitioner, who shall also ensure the safe keep of the petitioner and shall also ensure that the petitioner does not mingle with anti-social elements. This application is allowed. (RONGON MUKHOPADHYAY, J. ) 06. 05. 2026 S. B. Uploaded on 08. 05. 2026 -2-
