IN THE HIGH COURT OF ORISSA AT CUTTACK W. P. (C) No. 8367 of 2026 Sunita Padhi . … Petitioner Represented by Mr. S. C. Mekap, Advocate -Versus- State of Odisha & Others . … Opp. Parties Represented by Mr. S. S. Routray, Additional Standing Counsel CORAM: JUSTICE SASHIKANTA MISHRA ORDER 06. 04. 2026 1. This matter is taken up through hybrid mode. 2. Limited grievance of the petitioner is that the order passed by the appellate authority has not been implemented by the concerned Tahasildar. It appears that by order dated 23. 07. 2025 passed by the Sub-Collector, Bhanjanagar in Mutation Appeal Case No. 18 of 2025, the following directions were issued to the Tahasildar:- “After going through the arguments put forth by the learned counsel for the appellant, LCR and relevant documents, it is established that the appellant challenged the order passed by Tahasildar, Dharakote in M. C. No. 2176/2024.
In view of the above backdrop, this Court is satisfied that the Tahasildar, Dharakote has not adapted proper procedure while disposing of the mutation case. The order passed in M. C. No. 2176/2024 is hereby set aside. Accordingly, the appeal is allowed. The Tahasildar, Dharakote is directed to take steps towards issue of ROR in favour of appellant by following mutation procedure within three months from the date of receipt of this order. He is instructed to mutate the case after due field enquiry and report of Trace map of Revenue Inspector before issue of ROR. Send a copy of the final order to the Tahasildar, Dhrakote for information and taking necessary steps as per order. rd Order pronounced in the open court today i. e. on 23 July, 2025. ” 3. It is submitted that despite such clear direction the Tahasildar has not taken the necessary steps. 4.
Considering the limited grievance, the writ application is disposed of directing the Tahasildar, Dharakote to act upon the directions issued by the appellate authority as early as possible, preferably within four weeks from the date of production of certified copy of this order by the petitioner.
