Judgment text

IN THE HIGH COURT OF JHARKHAND AT RANCHI B. A. No. 2317 of 2020 Dilip Kumar Yadav … … … … Petitioner Versus The State of Jharkhand ... … ... … Opp. Party ------ CORAM: HON'BLE MR. JUSTICE DR. S. N. PATHAK ----- For Petitioner : Mr. Kamdeo Pandey, Advocate For Opp. Party : Mr. Rakesh Kumar No. 2, A. P. P. --- 02/ 19. 03. 2020 Heard learned counsel for the petitioner and learned counsel for the State. The petitioner is an accused in a case registered under Sections 467/468/420/120 B of the Indian Penal Code, in connection with Jamua P. S. Case No. 253 of 2016 corresponding to G. R. Case No. 3000 of 2016. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case due to malafide intention of the informant. The petitioner has already been granted anticipatory bail by this Hon’ble Court in ABA No. 1392 of 2018 and it was directed to deposit Rs.

30,000/-, within four weeks, but the petitioner could not deposit the same and also filed CrMP being Cr. MP No. 3877 of 2018 before this Court for extension of time to surrender before the learned court below, which was also allowed by this Hon’ble Court, but petitioner was not able to arrange the money and surrender before the learned court below as the petitioner is a poor person and works as daily labourer for his livelihood. Learned counsel further argues that other co-accuse person namely Arjun Pandit has been granted anticipatory bail by this Court in ABA No. 4861 of 2017 and the case of this petitioner stands on better footing of co-accused person. The petitioner is in judicial custody since 31. 07. 2019. Hence, learned counsel prays that on these grounds petitioner may be released on bail. Learned A. P. P. opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and also since the co-accused in similar circumstances has been granted anticipatory bail, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/( Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-II, Giridih, in connection with Jamua P. S. Case No. 253 of 2016 corresponding to G. R. Case No. 3000 of 2016, with the condition that the petitioner shall appear before the learned court below on each and every date and on account of even single default, his bail bond will be cancelled by the learned court bail. Resultantly, this bail application is allowed with the aforesaid condition. (Dr. S. N. Pathak, J. ) /punit/-
