Mohra Kalla, Raipur P. s. , Dist. Pali ----Respondents For Petitioner(s) : Mr. D. S. Udawat, through VC For Respondent(s) : Mr. Farzand Ali, G. A. -cum-A. A. G. , with Mr. B. R. Bishnoi, AGC Mr. R. S. Choudhary, through VC HON'BLE MR. JUSTICE SANDEEP MEHTA Order 17/12/2020 Learned counsel Mr. D. S.

Udawat submits that the petitioners may be allowed to raise all their objections before the trial court at the stage of framing of charges and the trial court in turn may be directed to consider and decide the said submissions by a reasoned order. Learned counsel, Mr. R. S. Choudhary, representing the respondent-complainant, does not object to the said submission. Thus, the petitioners are given liberty to raise all their valid objections before the trial court at the stage of framing of charges (in case, charges have not been framed till date) and in (2 of 2) [CRLMP-2757/2018] such eventuality, the trial court shall objectively consider and deal with the submissions of the petitioners by passing a reasoned order. With the above observations and directions, the instant miscellaneous petition as well as the stay petition are disposed of as withdrawn. (SANDEEP MEHTA),J 46-Pramod/-
