IN THE HIGH COURT OF ORISSA AT CUTTACK WPCRL No. 150 of 2025 Bishnu Priya Singh …. Petitioner Mr. Ambika Prasad Ray, Advocate -versus- State of Odisha and others …. Opposite Parties Ms. Suman Pattanayak, Addl. Government Advocate CORAM: HON’BLE THE CHIEF JUSTICE AND HON’BLE MR. JUSTICE MURAHARI SRI RAMAN ORDER 23. 12. 2025 Order No. 04. 1. Pursuant to order dated 02. 12. 2025, Mr. Chinmayee Kar, the Inspector-in-Charge and Mr. Udaya Kumar Das, the Asst. Sub-Inspector of Police of Nischintakoili Police Station are personally present before this Court. In pursuance thereof, the petitioner along with her husband is also present before this Court. 2. This writ petition in the nature of habeas corpus is taken out for a direction to the opposite party Nos. 1 to 5 to take appropriate steps to rescue the minor daughter of the petitioner who is allegedly in the custody of opposite party No. 6. 3. An instruction has come to be received by Ms. Suman Pattanayak, learned Addl.

Government Advocate from the Inspector-in-Charge, Nischintakoili Police Station in the district of Cuttack, which reveals that on 19. 12. 2025, being rescued after thorough search conducted by the police, a statement of the victim was recorded under Section 180 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (in short, „BNSS‟) by the WSI of Salepur Police Station. On her production before the ADJ-cum-Special Court, Cuttack under the Protection of Children from Sexual Offences Act, 2012 on 21. 12. 2025 a statement under Section 183 of the BNSS has been recorded. On 22. 12. 2025 being produced before the Child Welfare Committee (in short, “CWC”), Balasore, as the minor girl showed reluctance to be integrated with her parents, she was sent to Bashundhara Open Shelter House, Bidanasi, Cuttack for her safe custody and necessary counselling. 4.

In view of the above development, since the minor girl has already been rescued and put in safe custody by activating the CWC for the purpose stated above, and the parents being present before this Court conceded to such fact, this Court does not feel it appropriate to keep the writ petition pending as it would not subserve any fruitful purpose. 5. Accordingly, the WPCRL stands disposed of. (Harish Tandon) Chief Justice (M. S.
