[2026:RJ-JP:36080] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Criminal Miscellaneous Bail Application No. 7631/2026 CNR: RJHC010563152026 | URN: CRLMB / 16807U / 2026 Mohammed Ajhrudeen S/o Ahmad Ameer Khan, Aged About 31 Years, R/o Ward No. 26, Indrawati Basti, Ps Nohar, Tehsil Nohar, district Hanumangarh, Rajasthan (Presently Lodged In Sub Jail Rajgarh, District Churu) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Ganga Ram Bhari For Respondent(s) : Ms. Sonu Manawat, PP HON'BLE MR. JUSTICE BALJINDER SINGH SANDHU Order 03/08/2026 This application for bail under Section 483 BNSS (439 Cr. P. C. ) has been filed by the petitioner who has been arrested in connection with F. I. R. No. 146/2026, registered at Police Station Rajgarh, District Churu, for offences under Sections 8/21, 22 and 29 of the NDPS Act.

Learned counsel for the petitioner submits that, in the present case, the allegation against the petitioner is that he facilitated the supply of the capsules which were recovered from Rakhman. It is stated that nothing has been recovered from the petitioner and the alleged contraband recovered is 5. 84 grams of heroin and 17. 9 grams of tramadol, which is below the commercial quantity. Learned counsel further submits that the petitioner is in judicial custody since 17. 04. 2026. So far as the other cases are [2026:RJ-JP:36080] (2 of 3) [CRLMB-7631/2026] concerned, it is stated that the petitioner has been falsely implicated therein, as in the present case, nothing has been recovered from him. The investigation in the matter is complete and the charge-sheet has already been filed, a copy whereof has been placed on record. The trial of the case is likely to take a considerable time; therefore, the benefit of bail may be granted to the accused-petitioner.

Per contra, learned Public Prosecutor has opposed the bail application. This Court has considered the rival submissions, the facts and circumstances of the case, and perused the material available on record. Considering the fact that, in the present case, the allegation against the petitioner is that he facilitated the supply of the capsules which were recovered from Rakhman, and that nothing has been recovered from the petitioner. The alleged contraband recovered is 5. 84 grams of heroin and 17. 9 grams of tramadol, which is below the commercial quantity. The petitioner is in judicial custody since 17. 04. 2026. So far as the other cases are concerned, their are 16 cases out of which 7 are of similar nature and it is alleged that in no case anything has been recovered from his possession. The investigation in the matter is complete and the charge-sheet has already been filed, a copy whereof has been placed on record.

Hence, keeping in view the overall facts and circumstances of the case; conclusion of the trial of the case is likely to take time; the narcotic contraband alleged to be recovered from the petitioner is below commercial quantity; the prosecution has not [2026:RJ-JP:36080] (3 of 3) [CRLMB-7631/2026] shown any apprehension of the petitioner fleeing away from justice, in case he is enlarged on bail; but, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the petitioner under Section 483 of BNSS. Consequently, the bail application under Section 483 BNSS (439 Cr. P. C. ) is allowed. It is ordered that the accused-petitioner Mohammed Ajhrudeen S/o Ahmad Ameer Khan arrested in connection with FIR No. 146/2026, registered at Police Station Rajgarh, District Churu, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs. 1,00,000/- and two sureties of Rs.

50,000/- each, to the satisfaction of learned trial court, for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial. (BALJINDER SINGH SANDHU),J 47/Mayank Chouhan
