It is contended by the learned advocate for the petitioner that the petitioner has filed application under Section 14 of the SARFAESI Act on 30. 7. 2020, however, till today, learned District Magistrate has not provided any necessary administrative assistance to the petitioner.
It is also contended that as per the provision of the Act, it is the duty of the District Magistrate to provide assistance within 30 days. 3. Learned AGP has resisted this petition and contended that the District Magistrate is over burden and he is busy with the administrative work and considering the pandemic prevailing all over the country, there might be some delay. 4. After considering rival submissions and considering the mandate of the Act itself, the District Magistrate concerned is hereby directed to proceed with the application filed by the petitioner as early as possible, but not later than 20 days from the date of receipt of this order.
