JUSTICE SAMEER JAIN Order 09/12/2024 At the outset, learned counsel appearing for the petitioners has placed reliance upon the dictum encapsulated in Nisha Panwar Vs. Rajasthan Staff Selection Board in SBCWP No. 14401/2021, and has submitted that in light of the same, the petitioners herein may file a representation within a period of 10 days and directions can be given to the respondents to adjudicate the same. Mr. Sandeep Taneja, learned Additional Advocate General has submitted that the judgment of Ramdhan Kumawat Vs. State of Rajasthan in S. B. Civil Writ Petition No. 10622/2014 is not applicable in the given set of facts. Considering the rival arguments made by learned counsel for the parties, this Court grants a liberty to the petitioners to submit [2024:RJ-JP:50500] (5 of 5) [CW-12726/2024] their representation before the appropriate authority.
Respondents are directed to adjudicate the said representation within an upper limit of four weeks from the date of filing of representation, by way of a speaking order, following the principles of natural justice, and strictly in accordance with law and governing policies.
