[2026:RJ-JP:37432] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Criminal Miscellaneous Bail Application No. 10230/2026 CNR: RJHC010775922026 | URN: CRLMB / 22419U / 2026 Mani Ram Kukana S/o Sh. Uda Ram Kukana, Aged About 53 Years, R/o Kujati Ps -Kalu Now Punia Chowk Choudhary Colony Ps Ganga Sahar Bikaner (At Present Lodged In Central Bikaner) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. R. S. Gill For Respondent(s) : Mr. Hanuman Prajapati, PP HON'BLE MR. JUSTICE BALJINDER SINGH SANDHU Order 06/08/2026 Heard learned counsel for the parties and perused the material available on record. The petitioner has been arrested in connection with FIR No. 114/2026 of Police Station Gangashahar, District Bikaner, for the offences punishable under Sections 109(2), 115(2), 117(2), 126(2), 324(4) and 3(5) of the BNS. He has preferred this bail application under Section 483 of the BNSS.

Learned counsel for the petitioner submits that, in the present case, the dispute is between family members. The injured used to come to their house and abuse them. He is the younger brother of the petitioner. On the date of the incident as well, he came to their house and abused them, as a result of which a fight took place outside their house, resulting in the alleged injuries. It [2026:RJ-JP:37432] (2 of 3) [CRLMB-10230/2026] is stated that the fight occurred suddenly upon the instigation of the injured. Further, learned counsel submits that the interrogation notes recorded in respect of the other family members clearly reveal that the injured was under the influence of alcohol and abused the family members. He further submits that, after investigation, the charge-sheet has already been filed in the matter, the recoveries have been effected from the petitioner, and he is no longer required for investigation. The petitioner has been behind bars since 17. 06. 2026.

He further submits that even the statements of Jagdish reveal that there was a dispute between the family members. It is also submitted that the conclusion of the trial is likely to take a considerable amount of time. Per contra, learned Public Prosecutor has vehemently opposed the bail application. This Court has considered the arguments advanced by learned counsel for the petitioner and perused the material available on record. Having regard to the fact that the dispute is stated to have arisen between family members, the charge-sheet has already been filed, the recoveries have been effected from the petitioner, he is no longer required for investigation, and the petitioner has been behind bars since 17. 06. 2026, this Court finds it appropriate to enlarge the petitioner on bail.

Hence, keeping in view of the fact that the conclusion of the trial is likely to take time and the prosecution has not shown any apprehension of the petitioner fleeing from justice in case he is enlarged on bail, and without expressing any opinion on the [2026:RJ-JP:37432] (3 of 3) [CRLMB-10230/2026] merits of the case, this Court deems it just and proper to grant bail to the petitioner under Section 483 of the BNSS. Accordingly, the bail application filed under Section 483 of the BNSS is allowed. It is directed that the petitioner, Mani Ram Kukana S/o Sh. Uda Ram Kukana, shall be released on bail in connection with the aforesaid FIR, if not wanted in any other case, provided he executes a personal bond in the sum of Rs. 50,000/-with two sound and solvent sureties in the sum of Rs. 25,000/-each to the satisfaction of the learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the conclusion of the trial.
