Sr. No. 08 HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU MCC No. 194/2018 In SWP No. 59/2018 Abdul Rashid Bhat ….. Appellant(s)/Petitioner(s) Through: None Vs State of J&K and others . …. Respondent(s) Through: Mr. Ravinder Gupta, AAG Coram: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE ORDER 24. 12. 2024 1. This is an application seeking rectification of clerical error, which, as per the petitioner, has occurred in order dated 11. 01. 2018 passed in SWP No. 59/2018. It is submitted that the petitioner came to be appointed as casual labourer in the year 1997 but has been inadvertently indicated in the judgment sought to be correct as having been engaged in the year 1989. 2. With a view to verify the claim of the petitioner, record of SWP No. 59/2018 was sent for.

From a perusal of the record of the writ petition, it clearly transpires that the petitioner himself in para 3 of the writ petition has claimed that he was appointed by the respondents in the year 1989 and it is on the basis of this averment made in para 3 of the writ petition, year of engagement of the petitioner came to be recorded in the judgment as ‘1989’. 3. Be that as it may, the fact remains that the judgment passed by this Court does not suffer from any clerical or typographical error but reflects the year of engagement as was recorded in the writ petition. As to whether the petitioner was appointed in 1989 or in the year 1997 is subject to verification by the respondents while considering the claim of the petitioner for regularization in terms of SRO 520 of 2017 and, therefore, error pointed out is inconsequential. 4. This application is, therefore, found to be misconceived. The same is, accordingly, dismissed. (SANJEEV KUMAR ) JUDGE Jammu 24. 12. 2024 Vinod.
