C. , the accused-petitioner, namely, Musarak Ali has sought for bail in connection with Nagaon Police Station Case No. 2197/2020, registered under Section 366 of IPC. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor, appearing for the State. Also perused the materials on record.
From the FIR it appears that the accused, who is aged about 19 years have enticed the daughter of the informant and the victim eloped with the petitioner. It is noted that the accused is behind the bar sine 12. 09. 2020 and statutory period is over. Considering all entirety of the matter and the length of detention of the accused person it appears that further custodial detention of the accused person is not warranted. Accordingly, the present accused Page No. # 2/2 petitioner is hereby directed to be released on bail in connection with the case aforementioned on furnishing bail bond of Rs. 20,000/- with one suitable surety of the like amount each, to the satisfaction of the CJM, Nagaon.
