JUSTICE MANOJ KUMAR GARG Order 06/01/2025 The petitioners have been arrested in connection with FIR No. 496/2011 of Police Station Anti Corruption Bureau, Jaipur Chowki Udaipur, for the offence punishable under Sections 13(1) (C)(D), 13(2) of PC Act and Sections 193, 409, 420, 120-B IPC. They have preferred these bail applications under Section 483 of BNSS. Counsel for the petitioners submits that the petitioners are innocent and they have falsely been implicated in this case. Challan of the case has already been presented and no investigation is pending. The accused-petitioners are in judicial custody and the trial of the case will take sufficient long time to be concluded. Therefore, the benefit of bail should be granted to the accused-petitioners. Learned AAG has vehemently opposed the bail applications.
[2025:RJ-JD:523] (3 of 3) [CRLMB-89/2025] Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioners under Section 483 of BNSS. Accordingly, the bail applications filed under Sec. 483 of BNSS are allowed and it is directed that petitioners (1) Vimal Kumar Mehta S/o Late Shri Jaswant Singh, (2) Mukesh Jani S/o Late Shri Mohanshankar Jani, (3) Hemraj Vardar S/o Late Shri Kanhaiyalal Vardar & (4) Devesh Kumar Sharma S/o Late Shri Ratan Lal Sharma shall be released on bail in connection with FIR No. 496/2011 of Police Station Anti Corruption Bureau, Jaipur Chowki Udaipur, provided each of them executes a personal bond in a sum of Rs. 2,00,000/- with two sound and solvent sureties of Rs.
1,00,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial. (MANOJ KUMAR GARG),J 133 to 136-MS/-
