[2026:RJ-JP:36183] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Criminal Miscellaneous Bail Application No. 9562/2026 CNR: RJHC010689722026 | URN: CRLMB / 20857U / 2026 Aasu Lal S/o Shri Rama, Aged About 60 Years, R/o Ratdiya Ka Badla, Devgarh Police Station Devgarh District Rajsamand (At Present Lodged In Jail, Rajsamand) ----Petitioner Versus State Of Rajasthan, Through Public Prosecutor ----Respondent For Petitioner(s) : Mr. Dharmendra Singh Gaur For Respondent(s) : Mr. Hanuman Prajapati, PP HON'BLE MR. JUSTICE BALJINDER SINGH SANDHU Order 03/08/2026 This application for bail under Section 483 BNSS (439 Cr. P. C. ) has been filed by the petitioner who has been arrested in connection with F. I. R. No. 206/2026, registered at Police Station Deogarh, District Rajsamand, for offences under Section 115(2), 126(2), 117(2), 110, 190(2) and 191(2) of BNS.
Learned counsel for the petitioner submits that the offences alleged except Section 110 of BNS to have been committed by the petitioner are triable by the Court of Magistrate and no injury is dangerous to life which is clearly detected from the bail order of co-accused Dharmesha and Rahul who have been enlarged on bail by learned trial Court vide order dated 06. 07. 2026. He further submits that bail of the present petitioner was rejected by learned trial Court due to pending cases and majority of the cases are of Section 107 and 151 Cr. P. C. and the same has also been wrongly [2026:RJ-JP:36183] (2 of 3) [CRLMB-9562/2026] recorded by the trial Court. Learned counsel further submits that the petitioner has been in judicial custody since 30. 06. 2026 and that the trial is likely to take considerable time to conclude. Therefore, it is prayed that the benefit of bail be granted to the accused-petitioner. Per contra, learned Public Prosecutor has opposed the bail application.
Heard learned counsel for the parties and perused the material available on record. This Court has considered the facts and circumstances of the case; the alleged offences except Section 110 of BNS are triable by a Magistrate. Further, no injury is dangerous to life which is clearly detected from the bail order of co-accused Dharmesha and Rahul who have been enlarged on bail by learned trial Court vide order dated 06. 07. 2026. The bail of the present petitioner was rejected by learned trial Court due to pending cases and majority of the cases are of Section 107 and 151 Cr. P. C; keeping in view of the fact that conclusion of the trial of the case is likely to take time and the prosecution has not shown any apprehension of the petitioner fleeing away from justice, in case he is enlarged on bail; but, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the petitioner under Section 483 of BNSS.
Consequently, the bail application under Section 483 BNSS (439 Cr. P. C. ) is allowed. It is ordered that the accused-petitioner Aasu Lal S/o Rama arrested in connection with aforesaid FIR, shall be released on bail, if not wanted in any other case, provided [2026:RJ-JP:36183] (3 of 3) [CRLMB-9562/2026] he furnishes a personal bond of Rs. 50,000/- and two sureties of Rs. 25,000/- each, to the satisfaction of learned trial court, for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial.
