Toshi O Longkumer, learned counsel for the petitioners. Also heard Ms. V. Suokhrie, learned Addl. A. G ap-pearing for the respondents/contemnors. By way of this petition, under section 11 and 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India, the petitioner is seeking initiation of contempt against the respondents for alleged willful and deliberate violation of the order dated 09. 09. 2021 passed by this Court in W. A. No. 4/2020. Pursuant to the filing of the contempt petition the State of Nagaland as well as the private respondent in the aforesaid writ appeal i. e. W. A. No. 4/2020 have preferred SLP being SLP(C)17102 of 2021 and SLP(C) No. 1136 of 2022 (The State of Nagaland & Ors vs M. Moanungba & Ors and Mhabemo Ovung & Ors vs M. Moanungba & Ors) before the Apex Court against the aforesaid judgment and order dated 09. 09. 2021 passed by the Division Bench of this Court in the aforesaid writ appeal.
It is submitted at the bar that the Apex Court by judgment and order dated 28. 8. 2024 was pleased to allow the aforesaid appeals thereby setting aside the judgment and order dated 09. 09. 2021 passed by the Division Bench of this Court against which the present contempt petition is filed. That being so, nothing survives for adjudication in the instant contempt petition and accordingly, the contempt petition stands closed.
