[2026:RJ-JP:37274] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Civil Writ Petition No. 7534/2025 CNR: RJHC010310362025 | URN: CW / 12937U / 2025 M/s Praveen Industries, Having Its Office At Kumawato Ka Mohalla, Gowati, Sikar, Rajasthan, Through Its Proprietor Surgyan Kumawat, Aged About 42 Years. ----Petitioner Versus Rajasthan State Industrial Development And Investment Corporation Limited, Having Its Office At Industrial Area, Road No. 2, Pur Road, Biliya, Bhilwara, Rajasthan, Through Its Additional General Manager. ----Respondent For Petitioner(s) : None present JUSTICE ANOOP KUMAR DHAND Order 06/08/2026 1. The instant writ petition has been preferred by the petitioner-firm against the impugned order dated 10. 03. 2025, passed by the Additional General Manager, RIICO, Pur Road, Bhilwara, by which allotment letter issued to the petitioner for Plot No.
G-77 situated at Industrial Area, Bijolia, Bhilwara has been cancelled on account of the petitioner's failure to deposit balance installment within the time fixed by RIICO. 2. In the considered opinion of this Court, the aforesaid order passed by the Additional General Manager is appellable under the Rule 24(2)(b) of the RIICO Disposal of Land Rules, 1979 (for short "the Rules of 1979"), but without availing the aforesaid alternative statutory remedy of filing an appeal before the Appellate [2026:RJ-JP:37274] (2 of 2) [CW-7534/2025] Authority, the petitioner has straightaway approached this Court by way of filing the instant writ petition under Article 226 of the Constitution of India, bypassing the jurisdiction of the Appellate Authority. 3. On this count alone, the instant writ petition stands disposed of, granting liberty to the petitioner to file statutory appeal before the Appellate Authority. Stay application as well as all pending applications, if any, also stand disposed of.
4. In case, any such appeal is preferred by the petitioner within a period of one month from today, it is expected from the Appellate Authority to decide the said appeal expeditiously, as early as possible, after affording due opportunity of hearing to all the concerned in accordance with law, ignoring the period of limitation.
