51 Regular IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR WP(C) 2492/2023 CM(5901/2023) YASMEENA TABASUM ….. Petitioner (s) Through: Mr. Lone Altaf, Adv. V/s UNION TERRITORY OF J AND K AND ORS. ….. Respondent(s) Through: Mr. Waseem Gull, GA. Coram: Hon’ble Mr. Justice Sanjay Dhar, Judge ORDER 24. 11. 2025 1. The petitioner through the medium of present petition, has sought a direction upon the respondent to issue formal order of engagement in her favour and to consider her representation within a short span of time. 2. Heard learned counsel for the parties and perused the record. 3. It appears that pursuant to advertisement notice bearing No. CDPO of 2023 dated 16-05-2023 for filling up of vacancies of Sanginis (Anganwadi Workers) and Sahayikas (Anganwadi Helpers) in Anganwadi Centres inter alia for CS Pora B, Kamraz Mohalla (Anganwadi Workers), the petitioner offered her candidature by submitting her application.
It also appears that the official respondents issued a tentative list dated 19-06-2023, which was published in the newspaper on 20-06-2023 and the petitioner figured at Serial No. 33 of the said list. However, it seems that private respondent No. 5 filed objections to the said list, on the ground that the petitioner had passed post-graduation on the date of advertisement notification and she had concealed material facts before the official respondents at the time of submission of her application form. On account of this objection, the official respondents did not proceed further in the matter and no engagement orders in favour of any candidate has been issued so far. 4. Having regard to the nature of controversy involved in this case, the writ petition can be disposed of at this stage by extending appropriate directions to the official respondents with regard to holding of an enquiry in respect of the objection raised by private respondent No.
5 in respective of candidature of the petitioner. 5. Accordingly, the writ petition is disposed of with a direction to respondent No. 1 to 4 to enquire into the objections filed against the candidature of the petitioner within a period of one month from the date a copy of this order is made available to the said respondents whereafter they shall take a decision thereon in accordance with law for the purpose of taking the selection process to its logical conclusion.
