Sr. No. 07 HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU WP (C ) No. 1178/2020 CM No. 3422/2020 CM No. 3423/2020 Sanju Aggarwal …. Appellant/Petitioner(s) Through :- None. V/s Union of India and others …. Respondent(s) Through :- Mr. Suraj S. Wazir, Advocate for R-1 to 3. HON’BLE MR. JUSTICE ATUL SREEDHARAN, JUDGE Coram: HON’BLE MR. JUSTICE PUNEET GUPTA, JUDGE ORDER 27. 05. 2024 01. This petition has been filed in the year 2020. 02. By order dated 24. 07. 2020, this Court directed the issuance of notice returnable within four weeks, thereafter this case was listed on 28. 08. 2020 whereby, the Court recorded the fact that the hard copy of the petition is handed over to the learned counsel appearing for the Income Tax Department. Interim protection was given to the petitioner in terms of directions in para 6 of the said order where this Court finding prima facie case in favour of the petitioner, directed that recovery of the amount of tax as stated in the demand notice dated 12. 02.

2020 shall remain stayed. Thereafter, in para 7 of the said order, this Court has directed that the service of respondent No. 4 is yet to be effected. However, despite order dated 24. 07. 2020 and the passage of almost four years since then, petitioner has not taken steps for service of respondent No. 4. This Court sees this as blatant disregard to the earlier orders passed by the Court giving multiple opportunities to the petitioner to ensure service of notice upon respondent No. 4. 03. Today also, none appears on behalf of the petitioner and non-compliance of previous orders are staring this Court on its face. Under the circumstances, this petition is dismissed for want of prosecution and non-compliance. Interim orders, if any, having been passed earlier, as a consequence, shall also stand vacated.
