JUSTICE ANIL KUMAR CHOUDHARY For the Petitioner : Mr. Sabyasanchi, Adv. For the State : Ms. Shweta Singh, Addl. P. P. ------ 04/17. 12. 2020 Heard the parties through video conferencing. The petitioner has been made accused in connection with Rajpur P. S. Case No. 51 of 2010 corresponding to G. R. No. 915 of 2010 registered under Section 147, 148, 307, 333, 353 of the Indian Penal Code, Section 25 (1-B) a/26/35, 27 of Arms Act and Section 17 (1) (2) of C. L. A. Act and Section 10, 13, 20 of U. P. A. Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in an encounter between the police party and the extremists but the extremists managed to flee away and no injury has been sustained by the police party.
It is submitted that the allegation against the petitioner is false. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is lastly submitted that the petitioner has been in custody since 11. 01. 2019 which is evident from the impugned order. Hence, it is submitted that the petitioner be released on bail. Learned Addl. P. P. opposes the prayer for bail. Considering the facts of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Chatra in connection with Rajpur P. S. Case No. 51 of 2010 corresponding to G. R. No. 915 of 2010 with the condition that he will co-operate with the trial of the case. Animesh/ (Anil Kumar Choudhary, J. )
