P. ---th Order No. 02 Dated 04 December, 2020 Heard the learned counsel for the respective sides. Defects, as pointed out by the office, are ignored. The petitioner apprehends his arrest in connection with Saraiyahat P. S. Case No. 36 of 2020. It has been alleged that some persons in an inebriated condition were creating nuisance. When the police arrived they started scuffling and quarrelling with the police personnel. It appears that the implication of the petitioner is on account of the motorcycle of the petitioner having been recovered from the spot. There is no other evidence which would indicate the complicity of the petitioner.
Considering the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioner. The petitioner accordingly is directed to surrender before the learned court below within four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dumka in connection with Saraiyahat P. S. Case No. 36 of 2020. , subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands allowed. (RONGON MUKHOPADHYAY,J. ) MK
