Umakanta, learned PP, appears for the respondent.
[2] The present habeas corpus petition was listed on urgent mention and essentially prayed for a direction to the official respondents and in particular, the Officer-in-Charge, Mayang Imphal, Police Station directing the latter to produce the petitioner’s husband, namely Abdul Hekim @ Abdul Hakim before this Court and thereafter, to release him from the custody in terms of the pre-arrest bail order dated 30-08-2024 passed by the learned Sessions Judge, Thoubal in Cril. Misc. (AB) Case No. 54 of 2024 [Ref. : FIR No. 28(7) 2024 MI-PS U/s 447/325/354/506/120-B/34 IPC]. [3] It is an admitted position that subsequent upon the said order dated 30-08-2024, the husband of the petitioner was arrested by the st Manipur Police on 1 September, 2024 at Awa Palli at about 5. 00 p. m. [4] However, subsequent upon his arrest, the detainee has been released by the Manipur Police; having complied with the terms and conditions of the said pre-arrest bail order dated 30-08-2024 late yesterday evening.
[5] The habeas corpus petition has consequently been rendered infructuous and the learned counsel appearing on behalf of petitioner seeks leave to withdraw the same. [6] Directed accordingly.
