Vashum, learned GA appearing for the applicant and Mr. Ch. Tansen, learned counsel appearing for the respondent. At the outset, the learned counsel appearing for the respondent fairly submitted that he will have no objection in allowing the condonation application if the applicant is willing to pay some cost for the inconvenience caused to the respondent. Mr. Th. Vashum, learned GA appearing for the applicant submitted that the applicant is willing to pay costs to the respondent for any inconvenience caused to him.
In view of the submission made by the learned counsel appearing for the parties, this Court is of the view that it will be in the interest of justice to condone the delay in filing the connected appeal. Accordingly, the present application is allowed and the Page 1 delay of 1410 days in filing the connected appeal is hereby condoned subject to payment of cost of Rs. 3000/- to the counsel for the respondent. Subject to showing proof of payment of cost, Registry is directed to number the connected appeal and list it for admission hearing if the same is otherwise found to be in order.
