IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No. 1958 of 2026 Okil Majhi …. Petitioner Mr. S. G. Das, Advocate -Versus- State of Odisha …. Opposite Party Mr. S. Panda, ASC CORAM: MR. JUSTICE R. K. PATTANAIK ORDER 08. 04. 2026 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Muribahal P. S. Case No. 243 of 2025 corresponding to G. R. Case No. 231 of 2025 pending in the file of learned J. M. F. C. , Muribahal on the grounds stated. 3. Gone through the FIR as at Annexure-1. The name of the petitioner is mentioned in the report as the Labour Contractor. The Court finds that there were illegal labour transportation and rescue of ten labourers. It is however submitted that the petitioner does not have any criminal antecedent. Recorded the objection of the State.

The labourers were given false assurance of employment at Vijayawada in the State of Andra Pradesh and claimed to have been paid Rs. 45000/- each in advance but the petitioner and others do not have the labour license, hence, the FIR. Considering the submissions of learned counsel for the respective parties with claim that the petitioner is a fist-time offender having no previous antecedent and in the meantime, more than three months have gone by and under the impression that substantial part of investigation must have been over by now, this Court, though not in favour of considering his pre-arrest but is of the view that petitioner should instead surrender before the learned court below for being released with stringent conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned J. M. F. C.

, Muribahal in connection with Muribahal P. S. Case No. 243 of 2025 corresponding to G. R.
